ORDINANCE NUMBER 90-9367
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF
A CERTAIN NORTH -SOUTH ALLEY BETWEEN SANTA FE AVENUE AND SEVENTH
STREET IN THE ORIGINAL TOWNSITE.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That a portion of a certain North-South alley between
Santa Fe Avenue and Seventh Street, adjacent to the South forty feet (40') of
Lot 37, all of Lots 39, 41, 43, 45, 47 on Seventh Street, Original Townsite and
the South forty feet (401) of Lot 38, all of Lots 40, 42, 44, 46, 48 on Santa Fe
Avenue, Original Townsite; be and the same is hereby vacated subject to the
following conditions.
(a) The entire ten (10) foot alley be retained as a utility easement.
(b) That KPL Gas Service, Southwestern Bell Telephone and Salina
Cable TV System, Inc. agree to subordinate their easement rights
and entitlements under said utility easement to the easement
rights and entitlements of the City of Salina, Kansas.
Section 2. That the portion of public alley, vacated by this
ordinance, shall revert to the adjacent property owners in accordance with
K.S.A. 13-443.
Section 3. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
