ORDINANCE NUMBER 89-9323
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE
ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING
FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND
PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described has
been timely complied with, and SO NOW, THEREFORE,
AMENDMENT.
DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina,
duly adopted and published as a part of Ordinance Number 8526,
same being Chapter 42 of the Salina Code, be and it is hereby amended so that
the following described property be rezoned as follows, to -wit:
A tract of land in the Southwest Quarter of Section Thirteen
(13), Township Fourteen (14) South, Range Three (3) West
of the Sixth Principal Meridian, Saline County, Kansas,
comprised of the following property:
Lots 2, 4, 6, and 8 on Santa Fe Avenue, and Lots 1, 2, 3,
4, 5, 6, 7 and the North 77.50 feet of Lot 8 on Seventh
Street; Lots 1, 3, and 5 on Eighth Street, Hollands' Addition
to the City of Salina, Saline County, Kansas.
Lots 1, 2, 3 and 4, Surveyor's
Salina, Saline County, Kansas.
Also vacated Seventh Street from the south line of the North
77.50 feet of Lot 8 on Seventh Street in said Hollands'
Addition to the north line of Lots 1 and 2 on Seventh Street
in said Hollands' Addition. The preceding being more
particularly described as follows:
Beginning at the northeast corner of Lot 2 on Santa Fe
Avenue, said Hollands' Addition;
Thence 5.0002411611W. a distance of 820.00 feet to the
southeast corner of Lot 4, said Surveyor's Plat "D";
Thence N.89040127"W. a distance of 250.60 feet to the
southwest corner of Lot 4, said Surveyor's Plat "D";
Thence N.0002115911E. a distance of 210.84 feet to the
intersection with a circular curve having a radius of
45.00 feet, a central angle of 180100'00" and a long
chord of 90.00 feet bearing N.41034104"W;
Thence around said circular curve an arc distance of
141.37 feet to the intersection with the south line
projected of the North 77.50 feet of Lot 8 on Seventh
Street, said Hollands' Addition;
Thence N.891145'27"W. a distance of 145.02 feet along
the south line projected and the south line of the North
77.50 feet of Lot 8 on Seventh Street, said Hollands'
Addition to the southwest corner of said South 77.50
feet of Lot 8;
Thence N.00122155"E. a distance of 77.50 feet to the
southeast corner of Lot 5 on Eighth Street, said
Hollands' Addition;
Thence N .89°41'21 "W . a distance of 125.20 feet to the
southwest corner of Lot 5, said Hollands' Addition;
Thence N.00024123"E. a distance of 465.16 feet to the
northwest corner of Lot 1 on Eighth Street said
Hollands' Addition;
Thence N.89138159"E. a distance of 581.16 feet to the
point of beginning.
Containing 8.586 acres. (Bearings based on Solar
Observation)
shall become a part of District "PDD." PLANNED DEVELOPMENT DISTRICT.
That the use of said described property shall be subject to all the conditions,
restrictions and limitations as made and provided for in Ordinance Number 8526,
the same being Chapter 42 of the Salina Code with reference to the PLANNED
DEVELOPMENT DISTRICT.
Section 2. CONDITIONS OF APPROVAL. That the use of said
described property shall be subject to all the conditions, restrictions and
limitations as made and provided for in Ordinance Number 8526, the same being
Chapter 42 of the Salina Code, with reference to PLANNED DEVELOPMENT
DISTRICTS.
1. Development shall be in accordance with the approved
preliminary development plan, including preliminary
building elevation and landscaping plan, incorporated
herein by reference.
2. A final site development plan for Phase I shall be filed
within one (1) year; a final site development plan for
Phase II shall be filed within four (4) years; and the
entire development shall be substantially completed
within five (5) years of preliminary approval.
3. The building setback for Phase I MRI/Health Cath. Lab
shall be twenty-five feet (25') and the building setback
for Phase II Energy Center shall be twenty-five feet
(25') from the property line.

4. Signs #1 and #2 shall not exceed forty (40) square
feet; sign #3 shall not exceed twenty (20) square feet;
and signs #4 and #5 shall not exceed twelve (12) square
feet. All signs may be illuminated and shall not exceed
six (6) feet in height above grade.
5. The parking spaces facing Eighth Street in the
employee parking lot shall be deleted and replaced with
landscaping.
6. Area lighting shall be located and designed so as not to
cast any direct light on surrounding residential
property.
7. Proposed water line relocations / modifications, sewer
line connections and Seventh Street cul-de-sac
improvement shall be the responsibility of the applicant.
8. The final site development plan shall reflect all required
revisions and amendments, where appropriate.
Section 3. That upon receipt of
certification by
the Office
of the
Saline County Treasurer that all ad valorem
property taxes
are current
on the
real estate described in Section 1 , the City
Clerk is hereby
directed to
publish
this ordinance in the official city newspaper.
Section 4. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
