ORDINANCE NUMBER 03-10131
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF THE
DRAINAGE AND UTILITY EASEMENT ON LOTS 1-4, BLOCK 3, WOODLAND HILLS
ESTATES ADDITION TO THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on March 17, 2003, the governing body conducted a public hearing on the
petition of Darvin Dent, Landmark Development Company ("Petitioner") requesting vacation of the
drainage portion of the drainage and utility easement located at the rear of Lots 1 — 4, Block 3,
Woodland Hills Estates (also known as the 500 Block of Estates Drive) to in the City of Salina, Saline
County, Kansas.
hearing that:
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the
drainage utility easement.
(c) Injustice to the Petitioner drainage easement vacation of the drainage
portion of the drainage and utility easement should be granted.
Section 3. That the right-of-way is hereby vacated and shall revert to the owners of Lots
1— 4, Block 3, Woodland Hills Estates in the City of Salina, Saline County, Kansas, provided however:
(a) The owner of Lot 25, Block 3, Woodland Hills Estates Addition shall
dedicate an additional 20 -foot drainage easement on the south 20 -feet
of the north 40 feet of Lot 25, Block 3, Woodland Hills Estates
Addition in the City of Salina, Saline County, Kansas.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
