REGULAR MEETING OF THE BOARD OF COMMISSIONERS
February 3, 2003
4:00 p.m.
The City Commission convened at 2:30 p.m. in a Study Session for Finance Reports. The Regular
Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City -County
Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence.
There were present:

AWARDS - PROCLAMATIONS
None.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(5.1) Hearing to consider whether Patio Mobile Home Park should be closed due to deficiencies
within the park that has made it non-compliant with Chapter 22, "Mobile Homes and Trailer" of the
City of Salina Code.
Mayor Seaton opened the hearing.
Michael Morgan, Deputy City Manager, explained that Patio Mobile Home Park, located
at 1200 W. Crawford has not been properly licensed for several years as required by City Code. He
continued to explain that the owner has made some improvement, but the park is still not in
compliance. Mr. Morgan then outlined some of the deficiencies.
A discussion followed between Commissioner Shadwick, Commissioner Jilka, City
Manager Dennis Kissinger, and Mr. Morgan regarding the required license, the current code
requirements, and length of time Patio Mobile Home Park has been in operation.
Mike Roberts, Building Official, responded to Commissioners' questions regarding the
current water, sewer, and drainage conditions.
Ken Wasserman, 213 S. Santa Fe, attorney representing Patio Mobile Home Park,
commented that it was believed that the park was constructed in the 1940's. He also noted that his
client has made contact with Earles & Riggs Engineers & Planners to conduct an engineer study and
provide improvement suggestions on the water, sewer, and drainage systems serving the park.
A discussion followed between Mayor Seaton, Mr. Kissinger, and Mr. Wasserman
regarding an adequate amount of time for the Commission to be presented a follow-up report
regarding the deficiencies.

Mr. Wasserman confirmed to Commissioner Shadwick that Earles & Riggs would be
conducting a water, sewer, and drainage study.
Millard Pace, owner, commented on the water and sewer system serving the park. Mr.
Pace also responded to Mr. Kissinger's question regarding the ownership of the mobile homes in the
park and invited the Commission for a site visit of the park.
Commissioner Jilka commented on the conditions of the park during a visit in the past.
Mayor Seaton reemphasized that it was not the desire of the Commission to close the
facility, but making sure that all deficiencies were corrected.
There being no further comments, the hearing was closed.

the hearing on March 3, 2003 with a follow-up staff report of any correction and deficiencies on Patio
Mobile Home Park and a schedule for corrections to be met. Aye: (5). Nay: (0). Motion carried.

CONSENT AGENDA
(6.1) Approve the minutes of January 27, 2003.
Consideration of Item 6.1 was postponed until February 10, 2003.

ADMINISTRATION
(8.1) Second reading Ordinance No. 03-10126 amending Chapter 42, Article X, Division 2,
Section 42-517(7) of the Salina Code to allow internally illuminated signs in residential zoning
districts.
Mayor Seaton clarified that Ordinance No. 03-10126 was passed on first reading on
January 27, 2003 and since that time no comments have been received.
Moved by Commissioner Shadwick, seconded by Commissioner Heath, to adopt
Ordinance No. 03-10126 on second reading. A roll call vote was taken. Aye: (5) Divine, Heath, Jilka,
Shadwick, Seaton. Nay: (0). Motion carried.
(8.2) Second reading Ordinance No. 03-10127 providing for a change in zoning district
classification from R-1 (Single -Family Residential to I-2 (Light Industrial) District on property legally
described as Lots 1 & 2, and the south 100 feet of Lot 3 in Surveyor's Plat G to the City of Salina,
Saline County, Kansas and addressed as 333 N. Ohio.
Mayor Seaton clarified that Ordinance No. 03-10127 was passed on first reading on
January 27, 2003 and since that time no comments have been received.
Moved by Commissioner Heath, seconded by Commissioner Divine, to adopt Ordinance
No. 03-10127 on second reading. A roll call vote was taken. Aye: (5) Divine, Heath, Jilka, Shadwick,
Seaton. Nay: (0). Motion carried.
(8.3) First reading Ordinance No. 03-10130 levying special assessments for street and drainage
improvements in Woodland Hills Estates, Phase IV, Project No. 02-1371.
Shawn O'Leary, Director of Engineering and General Services, explained the project and
that the public hearing regarding the special assessments is scheduled for February 10, 2003.
Moved by Commissioner Divine, seconded by Commissioner Jilka, to pass Ordinance
No. 03-10130 on first reading. Aye: (5). Nay: (0). Motion carried.

(8.4) Request for Executive Session (personnel).
03-5873 Moved by Commissioner Shadwick, seconded by Commissioner Heath, to recess into
executive session for five minutes in order to discuss a personnel matter involving non -elected city
personnel for the reason that public discussion of the matter would violate the privacy rights of the
non -elected city personnel involved; and reconvene at 4:31 p.m. Aye: (5). Nay: (0). Motion carried.
The City Commission recessed into Executive Session at 4:26 p.m. and reconvened at
4:31 p.m. No action was taken.
