Smoke -Free Dining
Effective January 2003
Signage regarding smoke-free dining hours is required. The owner or person in
charge of a restaurant where smoking is regulated under Ordinance No. 02-
10077 shall post signs which clearly advise persons entering and dining at the
establishment whether smoking is prohibited generally, or prohibited only during
certain hours. The manner of such posting shall generally be at the discretion of
the owner, operator, proprietor or other person having control of the
establishment; provided, however, at a minimum, a sign must be conspicuously
posted at each public entry point, either on or adjacent to entry doorways or at a
location immediately inside the restaurant where persons may readily see the
signage prior to being seated.
All signage must be of a size, type and in appropriate locations to clearly advise
persons entering the restaurant of the smoking prohibitions. It is at the
discretion of the proprietor to post signage which indicates no specific hours
during which smoking is prohibited, or to indicate on the signage the 5:00 a.m. to
9:00 p.m. ordinance applicability.
