ORDINANCE NUMBER 86-9146
AN ORDINANCE RELATING TO PROCEDURES OF CONSIDERING A
VARIANCE OF REGULATIONS CONTAINED WITHIN THE FLOOD PLAIN
MANAGEMENT REGULATIONS; AMENDING SECTION 42-445 OF THE SALINA
CODE AND REPEALING THE EXISTING SECTION.
Kansas:
BE IT ORDAINED by the Governing Body of the City of Salina,
Section 1. That Section 42-445 of the Salina Code is hereby amended
to read as follows:
"Section 42-445. Findings required.
Any request for a variance may be granted only upon a
finding by the board of zoning appeals that:
(a) The conditions prerequisite to the granting of a
variance set forth in K.S.A. 12-715 have been met, and
(b) Issuance of the variance will not result in increased
flood heights, additional threats to public safety,
extraordinary public expense, create nuisances, cause
fraud on or victimization of the public, or conflict with
existing local ordinances or state laws, particularly
K.S.A. 12-734."
Section 2. That the existing Section 42-445 of the Salina Code is
hereby repealed.
Section 3. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
