80-8796 Zoning Permitted and Conditional UsesORDINANCE NUMBER 80-8796 (Published in The Salina Journal J dy 14 1980) AN ORDINANCE PROVIDING FOR THE AMENDMENT OF SECTIONS 36-600(1), 36-600(2), 36-601(1), 36-601(2), 36-602(l), 36-602(2), 36-603(1), 36-603(2), 36-604(1), 36-604(2), 36-604A(1), 36-6o4A(2), 36-605(1), AND 36-605(2), THE SAME BEING CHAPTER 36 OF THE SALINA CODE, AND REPEALING THE EXISTING SECTIONS. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That Section 36-600(1) of the Salina Code is hereby amended to read as follows: "Sec. 36-600(1). Permitted uses. 1. Agriculture, as defined in this chapter 2. Single-family dwellings. 3. Cemeteries, including crematories and mausoleums when used in conjunction with a cemetery, but not including mortuaries. 4. Dog kennels or animal hospitals, provided no structure or pen housing any animals shall be located nearer than seven hundred fifty (750) feet to the boundary of any residential district. 5. Family care facilities. 6. Oil or gas well drilling, provided such well is, or will be, located more than five hundred (500) feet from any school, residential district boundary, or any residential building other than a residential building occupied by the owner, lessee or operator of the premise on which the well is located. (See Section 36-600(2).) 7. Public service and public utility uses, as follows, provided such use is, or will be, located more than three hundred (300) feet from the boundary of any residential district. (See Section 36-600(2).) (a) Electric and telephone substations and distribution centers. (b) Gas regulator stations. (c) Poles, wires, cables, conduits, vaults, laterals, pipes, mains, valves and other similar equipment for the transmission, as distinguished from distribution to consumers, of telephone or other communications, electricity, gas or water, operated or maintained by a public utility, as defined in this chapter. (d) Police and fire stations. (e) Pumping stations. (f) Radio, television and microwave transmitting or relay stations and towers. (g) Telephone exchanges (h) Transformer stations. (i) Water reservoirs and standpipes (j) Ambulance service. 8. Recreational and social facilities, as follows: (a) Country clubs, including golf, swimming and tennis clubs. (b) Golf courses, but not including golf driving ranges, pitch and putt, or miniature golf courses. (c) Parks and playgrounds. (d) Privately owned dwellings for seasonal occupancy and not designed or used for permanent occupancy, such as summer homes and cottages, and hunting and fishing lodges and cabins. (e) public athletic fields. "Sec. 36-600(2). ConditionaZ uses. 9. Religious institutions, as follows: 2. (a) Churches, chapels, temples, synagogues, cathedrals, and shrines. 3. (b) Convents, seminaries, monasteries, and nunneries. 4. (c) Rectories, parsonages and parish houses. 10. Riding stables, provided no structure housing horses shall be located nearer than seven hundred fifty (750) 11. feet to the boundaries of any residential district. Well head stations, well separators and other similar 5. above -the -ground facilities customarily used for the distribution, transmission or storage of oil or natural gas, provided no such equipment shall be located nearer than five hundred (500) feet from the boundary of any residential district. Such equipment may be in enclosed buildings or in the open, but it must be completely enclosed behind a chain link fence with a two-inch or 6. less mesh, or its equivalent, not less than six (6) 7. feet in height. 12. Accessory and temporary uses, and home occupations, as 8. permitted by Article IV. 13. Signs, as permitted by Article IX. 14. Off-street parking, as required by Article X. Section 2. That Section 36-600(2) of the Salina Code is hereby Noncommercial recreational buildings, community centers, amended to read as follows: "Sec. 36-600(2). ConditionaZ uses. 1. Airports. 2. Campgrounds, subject to the provisions of Section 36-606(3)2 and 3. 3. Community sewage treatment plants. 4. Educational institutions as follows: (a) Boarding schools and academies (b) Colleges aand universities. (c) Primary, intermediate and secondary schools. 5. Excavation, extraction, or mining of sand, gravel, or other raw materials from the earth for resale. The conditions imposed on such excavation, extraction, or mining may include, but are not limited to, requirements for setbacks from schools and residential districts, screening, fencing, redevelopment, and restrictions on the grade of the excavation and vehicular access thereto 6. Greenhouses and nurseries. 7. Group day care centers when located in a non-residential building. 8. Group care facilities 9. Hospitals, sanitariums, rest homes and nursing homes. 10. Libraries and museums. 11. Noncommercial recreational buildings, community centers, auditoriums, stadiums and arenas. 12. Oil or gas well drilling when not permitted by Section 36-600(1). 13. Power plants. 14. Public service and public utility uses listed in Section 36-600(1)7, but which are, or will be located nearer than three hundred (300) feet to the boundary of a residential district. 15. Public utility substations. 16. Recreational facilities such as campgrounds, youth camps, gun clubs, and skeet and trap shooting ranges. 17. Sanitary landfill, subject to state requirements. Section 3. That Section 36-601(1) of the Salina Code is hereby amended to read as follows: "See. 36-601(1). Permitted uses. 1. Agriculture as defined in this chapter. 2. Single-family detached dwellings. 3. Family care facilities. 4. Golf courses, not including accessory clubhouses, golf driving ranges, pitch and putt or miniature golf courses 5. Parks and playgrounds. 6. Accessory and temporary uses and home occupations, as permitted by Article IV. 7. Signs, as permitted by Article IX. 8. Off-street parking and loading, as required by Article X. Section 4. That Section 36-601(2) of the Salina Code is hereby amended to read as follows: "Sec. 36-601(2). ConditionaZ uses. 1. Swimming clubs, tennis clubs and clubhouses accessory to golf courses. 2. Public utility uses, as follows, provided that the location is first approved by the planning commission, and provided further, that a landscape plan or screening plan, if necessary, is first approved by the planning commission: (a) Substations. (b) Gas regulator stations (c) Police and fire stations. (d) Pumping stations. (e) Ambulance services. 3. YMCA, YWCA and other similar uses, as defined in this chapter. 4. Hospitals, sanitariums, rest homes, and nursing homes. 5. Group care facilities. 6. Group day care centers. 7. Churches, chapels, temples, synagogues, cathedrals and shrines. 8. Schools: Primary, intermediate and secondary. Section 5. That Section 36-602(1) of the Salina Code is hereby amended to read as follows: "Sec. 36-602(1). Permitted uses. 1. Two-family dwellings. 3. Multifamily dwellings. 4. Rooming and boardinghouses. 5. Family care facilities. 6. Parks and playgrounds. 7. Home occupations. 8. Accessory and temporary uses, as permitted by Article IV. 9. Signs, as permitted by Article IX. 10. Off-street parking and loading, as required by Article X 11. Golf courses but not including accessory clubhouses or commercial golf driving ranges, pitch and putt or miniature golf courses. Section 10. That Section 36-604(2) of the Salina Code is hereby amended to read as follows: "Sec. 36-604(2). ConditionaZ uses. 1. Swimming clubs, tennis clubs and clubhouses accessory to golf courses. 2. That Section 36-604A(1) of the Salina Code is hereby amended to read as follows: ",Sec. 36-604A (1) . Permitted uses. 1. Single-family dwellings. 2. Two-family dwellings. 3. Multifamily dwellings. 4. Rooming and boardinghouses. 5. Family care facilities. 6. Group care facilities. 7. Parks and playgrounds. 8. Home occupations. 9. Accessory and temporary uses, as permitted by Article IV. 10. Signs, as permitted by Article IX. 11. Off-street parking and loading, as required by Article X. 12. Golf courses but not including accessory clubhouses or commercial golf driving ranges, pitch and putt or miniature golf courses. Section 12. That Section 36-604A(2) of the Salina Code is hereby amended to read as follows: "Sec. 36-604A(2). ConditionaZ uses. 1. Swimming clubs, tennis clubs and clubhouses accessory to golf courses. 2. Group day care centers and nursery schools. 3. Public utility uses, as follows, provided that the location is first approved by the planning commission and provided further that a landscape plan or screening plan, if necessary, is first approved by the planning commission: (a) Substations (b) Gas regulator stations. (b) Bulk regulations: (1) Maximum structure height: One hundred fifty (150) feet except as provided in Section 36-604A(2)9.(b)(2), below. (2) Minimum yard requirements: Front yard: Thirty (30) feet on all sides abutting a street. Side yard: Fifteen (15) feet except there shall be an additional side yard setback of one foot for each two (2) feet of height over fifty (50) feet. Rear yard: Twenty-five (25) feet. u 1 10. Pharmacies when located in a medical or dental office building, provided they can be entered only from an interior lobby or hallway and that there is no advertisi or display visible from the exterior of the structure. 11. That the existing Sections 36-600(1), 36-600(2), 36-601(1) 36-601(2), 36-602(1), 36-602(2), 36-603(1), 36-603(2), 36-604(1), 36-604(2), 36-604A(1), 36-604A(2), 36-605(1), 36-605(2), of the Salina Code are hereby repealed.
