81-8841 Buildings1 1 1 ORDINANCE NUMBER 81-8841 (Published in The Salina Journal (V V_Lr&P :,7 , 1981) AN ORDINANCE REGULATING FENCES ON DOUBLE FRONTAGE LOTS; ENACTING SECTION 9-352(1)b OF THE SALINA CODE. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That Article X of Chapter 9 of the Salina Code is hereby amended by adding the following section: "Sec. 9-352(1)b. Fences on double frontage Zots. Where a property consists of a lot, two opposite lot lines of which abut public streets which are, more or less, parallel thus requiring compliance with two front yard setbacks, a solid fence may be erected, not to exceed six (6) feet in height along the yard which has been designated as the rear yard by the owner or developer. When one of the streets abutting such a lot has been officially designated by the City of Salina as an arterial street, said fence shall not be erected in violation of Section 36-505 of the Salina Code (Obstructing Visibility at Intersections). However, when said fence would adjoin or would lie within twenty-five feet (25') of an adjacent unfenced front yard, a fence permit may be issued by the Building Inspection Department only if a written protest is not received within seven (7) days from the adjacent affected property owners. Said protest period shall commence on the date of receipt of a certified notice of intent from the Building Inspection Department." Section 2. This ordinance shall take effect and be in full force from and after its adoption and publication once in the official city newspaper. (SEAL) ATTEST: D. L.
