89-9164 Building Code Advis Bd(Published in The Salina Journal November , 1986) ORDINANCE NUMBER 86-9164 AN ORDINANCE CREATING THE BUILDING CODES ADVISORY AND APPEALS BOARD; REPEALING CERTAIN SECTIONS OF THE SALINA CODE INCLUDING ARTICLE II OF CHAPTER 8 (Sections 8-16 through 8-20); SECTION 8-38; SUBDIVISION II OF DIVISION 2 OF ARTICLE V OF CHAPTER 8 (Sections 8-96 through 8-100); SECTIONS 8-133 THROUGH 8-136; SECTIONS 8-203 THROUGH 8-207; ,AND DIVISION 3 OF ARTICLE VI OF CHAPTER 8 (Sections 8-226 through 8-233); DISBANDING THE BUILDING CODE ADVISORY BOARD, BOARD OF BUILDING CODE APPEALS, ELECTRICAL CODE PANEL, BOARD OF ELECTRICAL EXAMINERS, BOARD OF PLUMBING EXAMINERS, BOARD OF PLUMBING APPEALS; AND PROVIDING FOR A NEW ARTICLE 11 OF CHAPTER 8 OF THE SALINA CODE. Kansas: BE IT ORDAINED by the Governing Body of the City of Salina, Section 1. That Article 11 of Chapter 8 of The Salina Code is hereby amended to read as follows: "CHAPTER 8 ARTICLE If "Section 8-16. Creation of board. There is hereby created the Building Codes Advisory and Appeals Board (hereinafter referred to as "the Board") for the purpose of consolidating the functions previously performed by the Building Code Advisory Board, Board of Building Code Appeals, Electrical Code Panel, Electrical Board of Examiners, Board of Plumbing Examiners, Board of Plumbing Appeals. "Section 8-17. Membership. The Board shall consist of twelve (12) members, including one of each of the following: 1. licensed architect 2. licensed structural engineer 3. attorney 4. reactor S. plumbing contractor 6. master or journeyman plumber 7. electrical contractor 8. master or journeyman electrician 9. licensed mechanical engineer 10. heating and air conditioning contractor 11. home building contractor 12. general contractor "Section 8-18. Appointment and term. Members of the Board shall be appointed by the Mayor, with the consent of the Board of City Commissioners. Three of the initial members shall be appointed to a one (1) year term, three (3) to a two (2) year term, three (3) to a three (3) year term, and three (3) to a four (4) year term. All subsequent appointments shall be for a four (4) year term. No member shall serve more than two consecutive terms. "Section 8-19. Compensation. The members of the Board shall serve without compensation. "Section 8-20. Officers. The Board shall elect one of its members as chairman for a term of one (1) year. The chairman shall preside at all meetings of the Board. The Board shall elect, in the same manner and for the same term, one of its members as vice-chairman who shall act as chairman during the absence of the chairman. "Section 8-21. Quorum. Seven (7) members of the Board shall constitute a quorum for the purpose of conducting the board's business. "Section 8-22. Purpose. The purpose of the Board shall be to: - (1) Study all uniform codes and local ordinances adopted by the City regarding the residential and commercial building industry. (2) Make recommendations to the Board of City Commissioners regarding any updating of the City Building Codes. (3) Act in an advisory capacity to the Board of City Commissioners on any requests for ordinance changes affecting the City Building Codes. (4) Serve as a Board of Appeals to hear any appeal from a code interpretation by the Chief Building Official. (5) Recommend rules and regulations to be adopted by resolution of the Board of City Commissioners regarding the examination and licensure of plumbers, electricians, and gas fitters, including rules and regulations (a) governing the conduct and grading of such examinations; and (b) prescribing the requirements for passage of examinations. "Section 8-23. Appeal procedure. Any appeal to be heard by the Board must be filed within ten (10) calendar days from the date of the Chief Building Official's decision promting the appeal. Such appeal must be filed in the City's Permits and Inspections Department Office on a form provided by that office. The appeal shall then be placed on the agenda of the next regularly scheduled meeting of the Board. "Section 8-24. Meetings The Board shall determine its own meeting schedule; provided, however, that the Board must meet to conduct its business no less than quarterly. Special meetings of the Board may be called at the discretion of the chairman or the vice-chairman in the event the chairman is unavailable to consider the request for a special meeting. "Sections 8-25 - 8-35. Reserved." Section 2. That the existing Article II of Chapter 8; Section 8-38; Subdivision II of Division 2 of Article V of Chapter 8; Sections 8-133 through 8-136; Sections 8-203 through 8-207; and Division 3 of Article VI of Chapter 8 of The Salina Code are hereby repealed and the Building Code Advisory Board, Board of Building Code Appeals, Electrical Code Panel, Board of Electrical
