AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE
SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN
AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN
THE CITY AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, and SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. AMENDMENT. DISTRICT "P.D.D". PLANNED DEVELOPMENT
DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly
adopted and published as a part of Ordinance Number 8526, the same being Chapter
42 of the Salina Code, be and it is hereby amended so that the following
described property be rezoned as follows, to -wit:
Lot 7, Block 2, Georgetown Addition to the City of Salina,
Saline County, Kansas
shall become a part of District "P.D.D.". PLANNED DEVELOPMENT DISTRICT. That
the use of said described property shall be subject to all the conditions,
restrictions and limitations as made and provided for in Ordinance Number 8526,
the same being Chapter 42 of the Salina Code, with reference to PLANNED
DEVELOPMENT DISTRICTS, and in addition thereto shall be subject to the following
conditions, to -wit:
1. A Revised Preliminary Development Plan must be submitted within
30 days and with the following corrections:
(1) Marymount Road right-of-way must be changed to 40' from the
centerline, not 45' as indicated on the plan.
(2) The drive should not be indicated as a "street" on the
plan. It is a private drive.
(3) Label all driveways with a minimum with of ten feet.
(4) The middle drive onto Beechwood should be removed. It does
not meet the minimum distance between drives and is not
needed for access.
(5) The definition of "common area" was revised to include the
private drive. The definitions refer to the "street" which
would be changed to "private drive".
(6) The traffic flow for the parking area to serve the two
southwestern buildings should be opposite to that shown.
7 Letter the following onto the development plan:
"Off-street parking and loading spaces will be developed in
accordance with Article XI of the Zoning Regulations and
will be based upon the use and size of each building at the
time each is built."
(8) Add the City of Salina as an enforcer to Article V, Section
I of the Declaration of Covenants, Conditions, and
Restrictions for Wilbur Planned Development District.
2. A traffic control device, to be approved by the Fire Department,
must be installed at the private drive where it meets Marymount
Road.
3. The only permitted uses on said property shall be as follows:
conditioning of furs.

(21) Governmental buildings.
(22) Hardware stores.
(23) Hobby shops.

Appliance stores.
( 4)
Banks and financial institutions.
( 5)
Barber shops.

Beauty shops.
( 7)
Bicycle shops.
( 8)
Blueprinting and photostating establishments.

Business and professional offices.
(11)
Camera and photographic supply stores.
(12)
Carpet and rug stores.
(13)
China and glassware stores.
(14)
Contractor's office.
(15)
Department stores.
(16)
Drygoods stores.
(17)
Florist shops.
(18)
Furniture stores.
(19)
Furrier shops, including the incidental storage and
conditioning of furs.
(20) Gift shops.
(21) Governmental buildings.
(22) Hardware stores.
(23) Hobby shops.
(24) Interior decorating shops, including upholstering, making of
draperies, slipcovers and other similar articles which are
conducted as a part of, or secondary to, a retail operation.
(25) Jewelry stores.
(26) Leather goods and luggage stores.
(27) Mail order houses.
(28) Medical and dental clinics, and guidance centers.
(29) Music stores, and musical instrument sales and repair.
(30) Newsstands.
(31) Optical sales.
(32) Paint and wallpaper stores.

(34) Physical and health services such as private gymnasiums and
reducing salons.
(35) Radio and television broadcasting stations.
(36) Recording studios.
(37) Restricted production and repair limited to the following:
Alteration and custom tailoring of clothing for retail sale
only; jewelry from precious metal; watches; dentures;
optical lenses; and other similar activities.
(38) Schools: Music, dance or business.
(39) Tailor.
(40) Travel bureaus and transportation ticket offices.
(41) Variety stores.
4. Approval is subject to the revised Preliminary Development Plan
as required herein, which is on file in the City Clerk's Office
and is incorporated herein by reference.
5. Application for approval of Final Development Plan shall be filed
within three (3) years from the effective date of this ordinance.
Section 2. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
