02-10113 Vac Golden Eagle 2co�souaaieo-saimu (Published in the Salina Journal on, Decembed, 2002) ORDINANCE NUMBER 02-10113 AN ORDINANCE PROVIDING FOR THE VACATION OF THE UTILITY EASEMENT ON THE NORTHWEST PROPERTY LINE OF LOT 11, BLOCK 4, GOLDEN EAGLE ESTATES NO.2 IN THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on October 7, 2002 and November 4, 2002, the governing body conducted a public hearing on the petition of Tim Howison, on behalf of Bruce and Lenora Laffitte, ("Petitioner") requesting vacation of the utility easement located on the northwest property line of Lot 11, Block 4, Golden Eagle Estates No. 2 in the City of Salina, Saline County, Kansas, more particularly described as follows: hearing that: Beginning at the northerly corner of Lot Eleven (11), Block Four (4), Golden Eagle Estates No. 2; — Thence S36'05'35"W a distance of 10.00 feet to point of beginning; — Thence 536'05'35"W a distance of 188.10 feet; — Thence 553'54'25"E a distance of 10.00 feet; — Thence N36'05'35"E a distance of 188.10 feet; — Thence N36'49'55"W a distance of 10.00 feet to the point of beginning. Section 2. That the governing body finds from the evidence presented at the public (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by vacation of the utility easement. (c) In justice to the Petitioner vacation of the utility easement should be granted. Section 3. Said easement is hereby vacated and shall revert back to the owners of Lot 11, Block 4, Golden Eagle Estates No. 2 in accordance with K.S.A 13-443. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper. Introduced: November 18, 2002 Passed: November 25, 2002 tin M.
