11-10596 Water & Sewer Bonds(Published in the Salina Journal on April q) , 2011 ORDINANCE NUMBER 11-10596 AN ORDINANCE ESTABLISHING A WATER AND WASTEWATER SYSTEM MULTI- YEAR CAPITAL IMPROVEMENTS FUND. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Fund Established. In accordance with K.S.A. 12-1,118, there is hereby established a multi-year capital improvements fund to be entitled "Water and Wastewater Improvement Fund". Section 2. Purpose limited. The Water and Wastewater Improvement Fund shall be used only for the construction, repair, rehabilitation, alteration, installation, acquisition, or fabrication of water and wastewater system capital improvements as enumerated in the City of Salina Capital Improvements Program and as authorized by K.S.A. 12-1,118. This may include: A. Water and Wastewater infrastructure necessary to support economic development projects. B. Water infrastructure necessary to provide sufficient fire flow, flow and pressure for domestic. commercial, and industrial use, and adequate water quality throughout the system. C. Wastewater infrastructure necessary to provide reliable collection of community wastewater as well as wastewater treatment in compliance with all State and Federal regulations. D. Materials and supplies necessary to affect the purposes of the fund. E. Fixed or portable equipment provided that such equipment is dedicated solely to the operation i of water or wastewater facilities. F. Professional services contracts directly related to the primary purpose of the fund, including preliminary engineering, design and feasibility studies. I G. Other contractual services related to the primary purpose of the fund. H. Acquisition of real estate, improvements to real estate, and related personal property necessary to accomplish the purpose of the fund. 1. Payment of principal, interest and related costs of debt issued for water and wastewater improvements, either directly or through transfers to the Bond and Interest Fund. I i Work performed pursuant to the purposes of the Fund may be performed by the CO. or contracted to others. However, fund resources shall not be used for payment of salary or benefits paid directly by the I City of Salina to its employees, nor shall they be used to pay normal operating expenses of the City. i Section 3. Monies for the Fund. Monies for the fund may be provided through budgeted transfers from the Water and Wastewater Operating fund, from Bond and Temporary Note proceeds, special I assessments, reimbursements from other funds of the City of Salina, reimbursements or contributions from private agencies, or State or Federal Aid. Section 4. Annual Budget not Required. Pursuant to KSA 12-1,118, resources ofthe fund shall not be subject to the annual budget process. Section 5.
