11-10591 Vacate Riffel Addition(Published in the Salina Journal on March �� 201 1) ORDINANCE NUMBER 11-10591 f AN ORDINANCE PROVIDING FOR THE VACATION OF THE NORTH 20 FEET 1 OF A 40 FOOT EAST -WEST UTILITY AND DRAINAGE EASEMENT LOCATED ON LOT'S 1 AND 2, BLOCK 2 OF THE RIFFEL ADDITION NO. 2 TO TIIE CITY OF SALINA, SALINE COUNTY, KANSAS. BE ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on February 28, 2011, the governing body conducted a public hearing on the petition filed by Norm Riffel, President of Riffel Development Co., Inc., ("Petitioner") requesting vacation of the North Twenty (20) feet of a Forty (40) foot utility and drainage easement located on Lots 1 and 2, Block 2 of Riffcl Addition No. 2, more particularly described as follows: '1'lhc North Twenty (20) feet of a Forty (40) foot casement located along the South property line of Lots One (1) and 'I'wo (2) in Block Two (2) of Riffel Addition No. 2 to the City of' Salina. Saline County, Kansas, less the Fast Forty (40) feet and West Forty (40) feet thereof. Said tract contains 16,799 square foot more or less. Section 2. That the governing body finds from the evidence presented at the public hearing that: (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by the vacation of a portion of the existing utility/drainage easement on the lot. (c) In justice to the Petitioner the easement vacation request should be granted. i Section 3. That the above described portion of a Forty (40) foot utility/drainage easement located on Lots I and 2, Block 2 of Riffel Addition No. 2 is hereby vacated and full, unrestricted use of- this area shall revert to the owner of Lots 1 and 2, Block 2 of Riffel Addition No. 2 to the City of Salina, Saline County, Kansas, provided however that vacation of the above described utility/drainage easement is subject to the following conditions: a 1. All of' the remaining easement area shall be retained as a public utility and drainage easement. 2. A matching utility and drainage easement shall be dedicated on the abutting property to the south at the time that property is platted. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
