ORDINANCE, NUMBER 10-10587 AN ORDINANCE AMENDING CHAPTER 8, ARTICLE I, DIVISION 1 OF TIIE SALINA CODE PROVIDING LOCAL AMENDMENTS TO APPENDIX H (SIGNS) OF THE 2006 INTERNATIONAL BUILDING CODE AND CHAPTER 8, ARTICLE VI PERTAINING TO SIGNS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That Section 8-28 of Chapter 8, Article I, Division 1 of the Salina Code is hereby amended as follows: "Sec. 8-28. Amendment of Section I-1101.2 of the International Building Code. Section H101.2 is hereby deleted." Section 2. That Sections 8-28.1 and 8-28.2 are hereby added to Chapter 8, Article I, Division 1 ofthe Salina Code as follows: "Sec. 8-28.1. Amendment of Section I1102 of the International Building Code. /Section 11102 and its subsections are hereby amended to read as.follori)s. J See Sections 42.506 and 42-507 of the Salina Code for Classifications of Signs- Functional Types and Structural Types. Sec. 8-28.2. Amendment of Section H104.1 of the International Building Code. (Section 11104.1 is hereby amended to read as.follows.,J H104.1 Identification. Every advertising sign hereafter erected, constructed or maintained, for which a permit is required shall be plainly marked with the name of the person, firm or corporation erecting and maintaining such sign and shall have affixed on the front thereof the permit number issued for said sign or other method of identification approved by the building official." Section 3. That Sections 8-30 through 8-30.5 are hereby added to Chapter 8, Article I, Division 1 of the Salina Code as follows: "Sec. 8-30. Amendment of Section 1I105.5 of the International Building Code. (Section 1110..5 is hereby amended to read as, follovns: J 11105.5 Working stresses. In advertising signs, the allowable working stresses shall conform to the requirements of Chapter 16. The working stresses of wire rope and its fastenings shall not exceed 25 percent of the ultimate strength of the rope or fasteners. Exceptions: 1. The allowable working stresses for steel and wood shall be in accordance with the provisions of Chapters 22 and 23. 2. The working strength of chains, cables, guys or steel rods shall not exceed one-fifth of' the ultimate strength of such chains, cables, guys or steel. Sec. 8-30.1. Amendment of Section H106.1 of the International Building Code. /Section 11106.1 is hereby amended to read as follovi s: J 11106.1 Illumination. A sign shall not be illuminated by other than electrical means, and electrical devices and wiring shall be installed in accordance with the requirements of the currently adopted National Electrical Code. Any open spark or flame shall not be used for display purposes unless specifically approved. Sec. 8-30.2. Amendment of Section 11106.2 of the International Building Code. (Section 11106.2 is hereby amended to read as follovvs j 11106.2 Electrical service. Signs that require electrical service shall comply with the currently adopted National Electrical Code. Sec. 8-30.3. Amendment of Section H108 of the International Building Code. Section H 108 and its subsections are hereby deleted. Sec. 8-30.4. Amendment of Section H109.2 of the International Building Code. [Section H109.2 is hereby amended to read as.follows.I 11109.2 Required clearance. The bottom coping of every ground sign shall be not less than 6 feet above the ground or street level, which space can be filled with platform decorative trim or light wooden construction. Sec. 8-30.5. Amendment of Section H114 of the International Building Code. Section 1I114 and its subsections are hereby deleted." Section 4. That Article VI of Chapter 8 of the Salina Code is hereby amended as follows: "ARTICLE VI. SIGN CODE Sec. 8-236. General. All signs located outside of buildings shall conform to the requirements of the International Building Code as adopted by reference and amended pursuant to Chapter 8, Article 1 and Chapter 42, Article X of the Salina Code, for the purpose of providing minimum standards to safeguard life or limb, health, property and public welfare. Sec. 8-237. Permit required. No advertising sign shall hereafter be hung or erected until after a permit to hang, erect or locate the same has been obtained from the zoning administrator. No sign erected or constructed prior to the adoption of this code shall be relocated, rebuilt or remodeled without coming into compliance with the provisions hereof and until after a sign permit has been obtained to effect such alteration or relocation. Permits shall not be required for signs meeting the exemption requirements of sections 42- 504. 42-505 and 42-508 of Chapter 42 of the Salina Municipal Code of Ordinances. Sec. 8-239. Application. An applicant for permit shall complete and submit an application form available from the Development Services Department. The information to be provided shall include, but is not limited to, the following: (1) Address where the sign will be installed or altered. (2) Name of the property owner. (3) Name of the licensed sign installer. (4) Name of licensed electrical contractor for any electrical work associated with lighted signs. (5) Inventory of existing signs on the property (6) 'type and area of proposed sign (7) A site plan, drawn to scale, showing sign location (8) Shop drawings of proposed signage Sec. 8-240. Signs permit fees. Any person desiring a permit under the provisions of this section shall, at the time of' receiving such permit, pay to the city the fee as prescribed in Section 2-2. Section 5. That existing Sections 8-28 and 8-236 through 8-240 are hereby repealed. Section 6. This ordinance shall take effect and be in force from and after its publication in the official newspaper.
