10-10586 Zoning District Map Amendment(Published in the Salina Journal on December 2A—, 2010.) ORDINANCE NUMBER 10-10586 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF AND REPEALING ORDINANCE NUMBER 10-10548. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described have been timely complied with, SO NOW, THEREFORE, 13E IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT, DISTRICT "R" SINGLE FAMILY RESIDENTIAL. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is herby amended so that the following described property be rezoned as follows, to -wit: Lots One (1) through Twenty (20) in Block Four (4) of the Stone Lake Addition to the City of Salina, Saline County, Kansas. shall become part of DISTRICT "R" SINGLE FAMILY RESIDEN'T'IAL. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "R" SINGLE FAMILY RESIDENTIAL DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk. Section 3. AMENDMENT, DISTRICT "R-1" SINGLE FAMILY RESIDENTIAL. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 85261, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lots Sixteen (16) through Twenty -Six (26) in Block One (1), Lots One (1) through "Twenty - Seven (27) in Block Two (2), Lots One (1) through Thirty -Seven (37) in Block "three (3), Lots One (1) through Fifteen (15) in Block Five (5) and Lots One (1) through "Twenty (22) in Block Eight (8) of the Stone Lake Addition to the City of Salina, Saline County, Kansas, shall become part of DISTRICT "R-1" SINGLE FAMILY RESIDENTIAL. Section 4. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526. the same being Chapter 42 of the Salina Code with reference to the R-1 SINGLE I=AM11.Y RESIDFNTIAL DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk. Section 5. AMENDMENT. DISTRICT "R-2.5", MULTI -FAMILY RESIDENTIAL. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lots One (1) through Fifteen (15) in Block One (1) and Lots Two through Seven (7) in Block Seven (7) of the Stone Lake Addition to the City of Salina, Saline County, Kansas. shall become a part of DISTRICT "R-2.5" MULTI -FAMILY RESIDENTIAL. Section 6. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the R-2.5 MtJL'I'I- FAMILY RESIDENTIAL DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk. Section 7. AMENDMENT. DISTRICT "PC -2", PLANNED NEIGHBORHOOD SHOPPING DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lots One (1) through Six (6) in Block Six (6) of the Stone Lake Addition to the City of Salina, Saline County, Kansas. shall become a part of DISTRICT "PC -2" PLANNED NEIGHBORHOOD SHOPPING DISTRICT. Section 8. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the C-2 NEIGHBORIIOOD SHOPPING DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions. 1. Development of Lots 1-6, Block 6 shall be limited to those permitted uses listed in the C-2 district regulations, and shall be subject to all bulk, use and signage limitations in the C-2 district, except that the maximum building height shall be 35 feet. 2. A final site development plan for Lots 1-6, Block 6 shall be approved by the Planning Commission prior to issuance of any building permits on these lots. 3. Development of Lots 1-6, Block 6, including driveway access, landscaping and signage shall substantially conform to the approved site development plan and landscaping plan for the lot. Section 9. AMENDMENT, DISTRICT "PC -5" SERVICE COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property by rezoned as follows, to -wit: Lot One (1), Block Seven (7) in the Stone Lake Addition to the City of Salina, Saline County. Kansas. shall be part of DISTRICT "PC -5" SERVICE COMMERCIAL DISTRICT. Section 10. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the C-5 SERVICI: COMMERCIAL DISTRICT. Development of the property shall be subject to the plans on the with the City Planning Commission and/or City Clerk, and the following conditions: Development of Lot 1, Block 7 shall be limited to those uses permitted in the C-5 district regulations except for: a. automobile sales and service, b. automobile sales wholesale, c. boat sales, rental and service, d. contractor's office with outside storage, e. dog kennels, f. equipment sales and rental, g. garden store nurseries and greenhouses, retail garden stores without outdoor greenhouses would be allowed, h. pest control and exterminators, i. public utility substations, j. recreational vehicle rental, sales and service, k. truck sales and service, 1. lumber yards, and m. mini warehouse complexes. 3. A final site development plan for Lot 1, Block 7 shall be approved by the Planning Commission prior to issuance of any building permits on this lot. 4. Development of Lot 1, Block 7, including driveway access, landscaping and signage, shall substantially conform to the approved site development plan and landscaping plan for the lot. Section 11. AMENDMENT. DISTRICT "A-1", AGRICULTURAL DISTRICT. That the 7,oning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described unplatted tract be rezoned as follows, to -wit: A parcel of land located in the Southwest Quarter of Section 31, Township 14 South, Range 2 West of the 6`' Principal Meridian in Saline County, Kansas, more particularly described as follows: Commencing at the Southeast corner of said Southwest Quarter; thence on an assumed bearing of N 00°37'44" W along the East line of said Southwest Quarter a distance of 50.00 feet to a point on the North right-of-way line of Schilling Road, said point also being the POINT OF BEGINNING of the parcel to be described: - thence S 89'33'16" W along said North right-of-way line a distance of 1628.43 feet; - thence N 00°27'00" W a distance of 216.78 feet; - thence N 24°22'52" E a distance of 442.20 feet; - thence N 46°11'38" E a distance of 1195.90 feet; - thence N 09°59'44" E a distance 272.64 feet; - thence N 18°51'25" W a distance of 113.28 feet, - thence N 11 °49' 34" E a distance of 71.27 feet; - thence N 10°38'25" F., a distance of 104.90 feet; - thence N 06'22'33"E' a distance of 85.23 feet, - thence N 54°5925" E a distance of 288.58 feet; - thence N 89°4021" E a distance of 269.44 feet to a point on said Fast line of said Southwest Quarter; - thence S 00°37'44" E along said East line a distance of 2235.18 feet to the POINT OF BEGINNING; Said parcel contains 50.42 acres, more or less and is subject to easements, reservations_ and restrictions of record. Section 12. That Ordinance Number 10-10548 is hereby repealed. Section 13. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
