10-10582 Vacate Hurd Plaza Addition(Published in the Salina Journal on December,;Z�2010) ORDINANCE NUMBER 10-10582 AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF A 20 - FOOT UTILITY EASEMENT LOCATED ON LOT 1, BLOCK I OF THE HURD PLAZA ADDITION TO THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on December 13, 2010, the governing body conducted a public hearing on the petition initiated by the City of Salina, on behalf of Unified School District No. 305, (-Petitioner") requesting vacation of a portion of a Twenty (20) foot platted utility casement located on Lot 1, Block l of the Hurd Plaza Addition, more particularly described as follows: E Commencing at the Southeast corner of said Lot 1; - thence on an assumed bearing of South 80°37'06" West on the South line of said Lot l . a distance of 20.27 feet to the Point of Beginning; - thence North 00°01'23" West, a distance of 20.27 feet to the platted easement line of said Lot 1; - thence South 80°37'06" West on said platted easement line, a distance of 47.37 feet; - thence North 40°51'25" West on said platted easement line, a distance of 414.61 feet: thence North 00°06'46" East on said platted easement line, a distance of 99.47 feet: - thence South 89°56'45" East on said platted easement line, a distance of 81.39 feet; thence North 00°00'00" East on said platted easement line, a distance of 49.97 feet; - thence North 89°57'33" West, a distance of 20.22 to the West Lot line of said Lot 1, thence South 00°14'56" East, a distance of 29.97 feet to a corner of said Lot 1; - thence North 89°56'45" West, a distance of 81.26 feet to the Northwest corner of said Lot 1; I - thence South 00°06'49" West, a distance of 126.93 feet to a corner of said Lot 1; - thence South 40°51'25" East, a distance of 433.29 feet to the Southwest corner of said Lot 1; - thence North 80°37'06" East, a distance of 55.28 feet to the Point of Beginning. Said Tract contains 14,205 square feet, more or less. I �! Section 2. That the governing body finds from the evidence presented at the public hearing that: i (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by the vacation of a portion of the public utility casement on this lot. (c) In justice to the Petitioner the easement vacation request should be granted. s i Section 3. That the above described portion of the Twenty (20) foot platted utility casement located on Lot 1, Block 1 of the Hurd Plaza Addition is hereby vacated and full, unrestricted use of this area shall revert to the owner of Lot 1, Block 1 of the Hurd Plaza Addition to the City of Salina, Saline County, Kansas. i!
