10-10581 Vacate Wheatridge Addition(Published in the Salina Journal on Decemberl�'2010) ORDINANCE NUMBER 10-10581 AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF A 20 - FOOT EAST -WEST UTILITY EASEMENT LOCATED ON LOT 3, BLOCK 2 OF THE WIIEATRIDGE ADDITION TO THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on December 13, 2010, the governing body conducted a public hearing on the petition filed by L&S, LLC ("Petitioner") requesting vacation of a portion of a Twenty (20) foot utility easement located on Lot 3, Block 2 of the Wheatridge Addition, more particularly described as follows: Commencing at the Northeast corner of said Lot 3; thence on an assumed bearing of S 00°01'26" W along the East line of said Lot 3 a distance of 125.50 feet to a point on the South line of a Utility Easement; thence S 89°37'45" W along said South line a distance of 108.65 feet to the POINT OF BEGINNING of the parcel to be described, - thence continuing S 89°3745" W along said South line a distance of 104.34 feet; - thence N 00°21'35" E a distance of 20.00 feet to a point on the North line of said 20' Utility Easement; - thence N 89°37'45" E along said North line a distance of 104.34 feet; - thence S 00°21'35" W a distance of 20.00 feet to the POINT OF BEGINNING Said tract contains 2,087 square feet, more or less. that: Section 2. That the governing body finds from the evidence presented at the public hearing (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by the vacation of a portion of the existing utility easement on the lot. (c) In justice to the Petitioner the easement vacation request should be granted. Section 3. That the above described portion of a Twenty (20) foot utility easement located on Lot 3, Block 2 of the Wheatridge Addition is hereby vacated and full, unrestricted use of this area shall revert to the owner of Lot 3, Block 2 of the Wheatridge Addition to the City of Salina. Saline County, Kansas. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
