AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER
8526, THE SAME BEING CHAPTER 42 OF 'TIIE SALINA CODE, AND THE ZONING
DISTRICT MAP THEREIN AND TIIEREBY ADOPTED AND PROVIDING FOR TIIE
REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE
PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the
a rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW,
TIIEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section]. AMENDMENT. DISTRICT "PDD R-3". MULTI -FAMILY RESIDENTIAL
PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina,
Kansas, duly adopted and published as apart of Ordinance Number 8526, the same being Chapter 42 of
the Salina Code, be and it is hereby amended so that the following described property be rezoned as
follows, to -wit:
All of Lots 1, 2, 3, 4, 6, 10, and Lot 8 except the South 50.0 ft. of the East 50.0 ft.
thereof, in the Atherton -Phillips Addition to the City of Salina, Saline County,
Kansas; and the West 90.0 ft. of Lot 24, Surveyor's Plat "G", City of Salina,
Saline County Kansas more commonly known as 155 N. Oakdale Avenue.
shall become a' part of District 'PDD R-3". MULTI -FAMILY RESIDENTIAL PLANNED
DEVELOPMENT DISTRICT.
Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be
subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number
8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT
DISTRICT and the R-3 District Regulations. Development of the property shall be subject to the plans
on Tile with the City Planning Commission and/or City Clerk and the following conditions, to -wit:
1. Development limitations shall be as follows:
a. Permitted uses in this district shall be limited to a children's center facility consisting of
administrative and medical offices and treatment rooms and a child care center and
accessory play areas, support facilities and buildings.
b. Development within the district shall be subject to the minimum building setback,
maximum building height and maximum lot coverage limitations and use limitations of
the R-3 (Multi -Family Residential) district, except that the side yard setback requirement
for the building shall be reduced to fifteen (15) feet.
a Signage within the district shall be subject to the sign limitations in the R-3 district
regulations except that one (1) monument sign and two (2) wall signs shall be permitted
per street frontage and a sign setback of five (5) ft. from Ash Street, Oakdale Avenue
and Johnstown Avenue shall be permitted.
2. The final location and design of the proposed driveway entrances on Ash Street and Oakdale
Avenue shall be reviewed and approved by the City Engineer prior to issuance of a building
permit.
3. The final site development plans submitted for a building permit shall be in substantial
conformance with the approved preliminary development plan, landscape plan, and
elevation drawings. Plans for plant materials, signage, site lighting and dumpster enclosures
shall be shown on the final site development plan submitted for a building permit.
Section 3. That all prior ordinances in conflict herewith as they relate to the above described
real estate are hereby repealed.
Section 4. That this ordinance shall be in full force and effect from and after its adoption and
publication once in the official city newspaper.
