AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, 7'HE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND TIIE
w
ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR
THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING
THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the
rezoning of certain property therein, hereinafter described has been timely complied with, SO
NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. AMENDMENT. PLANNED C-1 PLANNED RESTRICTED BUSINESS,
That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of
Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby
amended so that the following described property be rezoned as follows, to -wit:
Lots One (1) and 'Two (2), Block Seven (7), Rolling Hills Addition, to the City of Salina,
Saline County, Kansas; more commonly known as 680 S. Marymount Road.
shall become a part of District "PC -1". PLANNED RESTRICTED BUSINESS.
Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be
subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number
8526, the same being Chapter 42 of the Salina Code with reference to the "C-1" Pj-'STRICTED
BUSINESS District Regulations. Development of the property shall be subject to the plans on file with
Section 3. DEVIATIONS FROM 11C-1" RESTRICTED BUSINESS DISTRICT
REGULATIONS. The following deviations from the underlying district regulations were approved
by the Planning Commission for this plan under the authority in Section 42-410 (e):
1. A five (5) foot reduction of the front yard building setback required in Section 42-255 (2)
a. I .iii. from 75 feet from the center line to 70 feet from the center line of Crawford Street.
2. An exception to Section 42-79 (2) and Section 42-255 (2) a.l.ii. to allow a fenced in trash
enclosure to be located within the front yard setback area on Marymount Road.
3. A waiver of requirement in Section 42-256(3) that a six (6) foot screening fence be
provided along the north property line abutting a residential district (the fire station site).

Planning Commission and/or City Clerk, and the following conditions, to wit:
1.
Uses on Lots One (1) and Two (2), Block Seven (7) of the Rolling Hills Addition shall
be limited to an office building for business and professional offices and medical and
dental offices and shall be subject to the bulk and use limitations of the C-1 (Restricted
Business) district.
2.
A total of one (1) monument sign and two (2) wall signs shall be permitted. No wall
signs shall be permitted on the west side of the building. Signage shall comply with the
C-1 district maximum size limitation of 32 square feet.
3.
A detailed planting plan and irrigation plan shall be submitted and approved prior to
issuance of a building permit for this site. Tree and plant varieties shall be from the
City's Recommended Tree List and Xeriscaping Plant List.
4.
A public sidewalk shall be constructed along Marymount Road as part of development of
the site.
5.
The applicant shall submit a site lighting plan confirming that no light shall spill onto
adjacent property and shall submit cut sheets of exterior lighting fixtures for review prior
to issuance of a building permit.
6.
Development of the site shall be completed in substantial conformance with the
approved site development plan, landscape plan and associated sign and building,
elevation drawings which are hereby incorporated by reference.
7.
A building permit for this project shall be obtained within 18 months of site plan
approval.
Section 3. DEVIATIONS FROM 11C-1" RESTRICTED BUSINESS DISTRICT
REGULATIONS. The following deviations from the underlying district regulations were approved
by the Planning Commission for this plan under the authority in Section 42-410 (e):

real estate are hereby repealed.
Section 5. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
