ORDINANCE NUMBER 10-10572 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, TIIE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOP'T'ED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WIIEREAS, all conditions precedent for the amendment of the Zoning District Map, the o rezoning of certain property therein, hereinafter described has been timely complied with, and SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "R-1". SINGLE-FAMILY RESIDENTIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly. adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code and Section 1. of Ordinance Number 91-9444, be and are hereby amended so that the following described property be rezoned as follows, to -wit: The West One Hundred (100) feet of Lot Pour (4), Block Eight (8), Sunset Manor Addition to the City of Salina, Saline County, Kansas. shall be removed from the Sunset Plaza, Inc. Planned Development District and shall become a part of District "R -I". SINGLE-FAMILY RESIDENTIAL DISTRICT. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitation as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "R-1" SINGLE- FAMILY RESIDENTIAL DISTRICT and use and development of the property shall no longer be subject to the approved plans on file with the Planning Commission and/or City Clerk for the Sunset Plaza, Inc. Planned Development District. Development on the remainder of Lot 4 shall remain subject to the approved plans on file with the Planning Commission and/or City Clerk for the Sunset Plaza, Inc. Planned Development District and the following conditions, to -wit: 1. The installation of a six foot (6') solid fence along the south and west sides of the expanded parking areas as shown on the submitted site plan. 2. Completion of a drainage swale in the rear and side yard of Lot 4 to carry surface water to Osage Street. 3. Extension of an underground drainage intake pipe to the inlet in the expanded parking area. Section 3. That all prior ordinances in conflict herewith as related the above described real estate are hereby repealed. Section 4. That this ordinance shall be in full fotce and effect from and after its adoption and publication once in the official city newspaper.
