vacation of ash st. 12/4/1979December 4, 1979 TO: Bill Harris, Assistant City Manager FROM: Don Hoff, Assistant City Engineer SUBJECT: Vacation of Ash Street In accordance with our conversation yesterday, we have prepared a legal description for the vacation of a portion of West Ash Street, lying west of Broadway Boulevard. When this portion of Ash Street is vacated, we can proceed to write a single legal description encompassing Tract 1, Tract 2, and the vacated street right-of-way. Enclosed is an ordinance form for the Ash Street vacation and also a location map. DH:MKP ENC: (2) Respectfully submitted, -7 , /' � //- Don Hoff, P. r ORDINANCE NUMBER (Published in The Salina Journal 1980 AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF ASH STREET, A PUBLIC STREET IN THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That a portion of right-of-way of Ash Street, in the City of Salina, Saline County, Kansas, described as follows: Beginning at a point on the north right-of-way line of Ash Street that is one hundred three feet (103.00') west of the southwest corner of Lot Three (3), Block Nine (9), Elmdale Addition to the City of Salina; thence west along said north right-of-way line a distance of one hundred seventy-five and five tenths feet (175.50') to the centerline of the old Dry Creek channel; thence southeasterly along the centerline of the old Dry Creek channel to the south right-of-way line of Ash Street; thence east one hundred feet (100.00') along the south right-of-way line of Ash Street to a point - that is one hundred three feet (103.00') west of the northwest corner of Lot One (1), Block Five (5), Elmdale Addition to the City of Salina; thence north eighty feet (80.00') to the point of beginning. Said tract contains 0.25 acres, more or less. be and the same is hereby vacated. Section 2. That the above named portion of Ash Street, which is vacated by this ordinance, shall revert to the adjacent property owners in accordance with K.S.A. 13-443. Section 3.
