AGREEMENT
PRESENTS:

as, for certain street and utility improvements
to the

WHEREAS, the City of Salina has adopted Resolution Numbers
3113 and 3119 which require that the petitioner for improvements
which confers special benefits on unimproved and undeveloped
property shall be required to. pay, in cash, a minimum of fifty
percent (50%) of *the cost of such improvements prior to the
awarding of such contract or in lieu of such cash deposit above
mentioned file with the City Clerk an indemnity bond or agreement
executed by one or more sureties acceptable to the City of Salina
which bond or agreement agrees to indemnify or hold harmless the
City from any.loss resulting from such special assessments levied
against their property as the result of said improvements; and,
WHEREAS, the undersigned is willing to guarantee unto the
City of Salina, Kansas, that upon demand made upon the undersigned
that it will forthwith pay to the City of Salina such sum or sums
of money as requested for such improvements, but in no event to
exceed $
NOW, THEREFORE, the undersigned, in consideration of the
City of Salina, Kansas, awarding contracts for the construction
