Report on Petition Number 4029 requesting vacation of the 20 -foot utility
easement on the west side of Lot 2 and the west 10 feet of the 20 -foot utility
easement on the east side of Lots 2 and 3, Block 1, King Addition.
Background
The petition was submitted by John C. Marietta, owner of Lots 2 and 3, on
February 26, 1992. Mr. Marietta desires to develop the lots and would like
full utilization of the area void of any easements. This area is located at
the southwest corner of Ohio and Cloud as shown on the attached sketch.
The area was originally platted in 1957, replatted in 1965 and finally
replatted again in January 1990 as King Addition. The easements were platted
to provide access to the utility companies for Lots 1 and 2. All franchise
utility companies have been contacted regarding this proposed vacation. No
utilities currently exist in the easements nor are any future utilities planned
for the area.
Recommendation
It is recommended that the City Commission approve the ordinance vacating the
20 -foot utility easement on the west side of Lot 2 and the west 10 feet of the
20 -foot utility easement on the east side of Lots 2 and 3, Block 1, King
Addition.
