It has come to our attention that you are filling, causing to be
filled or allowing to be filled a portion of the old Smoky Hill River
channel where it meanders through the northeast corner of the Southwest
Quarter of the Northwest Quarter of 'Section Thirty (30), Township Fourteen
(14) South, Range Two (2) West of the Sixth Principal Meridian in Saline
County, Kansas, adjacent to land owned by D. V. Incorporated. This
property is Lots One (1) and Two (2), Block Nine (9), Shalimar Plaza
Addition to the City of Salina and addressed as 2003 and 2007 Mission Road.
You are hereby put on notice that the City of Salina, Kansas obtained
ponding rights in this channel, being necessary for the protection of public
and private property from flooding, through the Saline County District Court
in 1958.
You are hereby ordered to immediately cease all filling operations,
as it affects the above described portion of this river bed. You are
further ordered to remove any fill material that has been deposited in
the above described portion of this river bed to re-establish its natural
bank lines.
