usd305 kenwood dressing room 8/23/1977/,� c f 4 This Addendum, made and entered into this day of March, 1984, by and between the CITY OF SALM, KANSAS, a mumcip corporation, herein referred to as the "City", and UNIFIED SCHOOL DISTRICT NO. 305 of Salina, Saline County, Kansas, herein referred to as the "School District", WITNESSEIH: WHEa;EA.S, on the 23rd day of August, 1983, the City and School District entered into an Agreement pertaining to the use of property located in Kenwood Park; and, WHEREAS, the School District no longer has need for a portion of the Property assigned to its control under said agreement; and, NOW THUMFORE, in consideration of the mutual covenants herein contained it is mutually agreed by and between the parries hereto as follows: (1). That the area designated as "dressing room facility" and indicated as #5 on the map attached to the Agreement, is hereby deleted from the area in Kenwood Park over which the School District shall have the exclusive use and control and said area #5 shall revert to the exclusive use and control of the City. (2). That all other terms, conditions and covenants contained in the original agreement dated August 23, 1983, are hereby ratified and affirmed by the parties. CITY OF SALM, KANSAS By UNIFIED SCHOOL DISTRICT NO. 305 By A G R E E M E N T r r This Agreement, made and entered into this 23rd day of August,. 19770 by and between THE CITY OF SALINA, KANSAS, a municipal corporation, herein- after referred to as the "City", and UNIFIED SCHOOL DISTRICT #305 of Salina, Saline County, Kansas, hereinafter referred to as the "School District"s WITNESSETH: WHEREAS, the City is the owner of a tract of land located within the corporate Iimits of the City of Salina, Kansas, commonly.known as Kenwood Park; and, WHEREAS, the School District has for many years last past used and ,-maintained .a portion of said Kenwood Park for an athletic field; and the dressing room facility noted as Soon the attached map; and, WHEREAS, the parties hereto desire to avoid any misunderstanding in the future as to the possible use of the said athletic field and dressing room facility by the School District. NOIV THEREFORH, in consideration of the mutual covenants herein contained it is mutually agreed by and between the parties hereto as follows: (1). That during the term of this agreement the School District shall have the exclusive use and control of the following described area located in Kenwood Park, to wit: By the attached map as noted by the broken lines. (2). This agreement shall remain in full force and effect from the day hereof until the 19th day of March, 2009. (3). That all prior agreements, whether written or oral, between the City -and the School District, pertaining to the use of any land in Kenwood Park are hereby terminated as of the date of this agreement.
