The normal method of obtaining water service, to a property within
the city limits, is to obtain signatures of more than fifty percent (50%)
of the property owners that would be assessed for the improvement on a
petition requesting the same. The improvement would then be put in by
resolution under State Statute 12-6a. There would then be a protest
-period during which, if a protest was filed and signed by more than
fifty percent (50%) of the property owners in the benefit district and
they own more than fifty percent (50%) of the property within the district,
the improvement would be denied.
The other method of obtaining such improvements is for the requesting
party to pay in cash to the city one hundred percent (100%) of the cost of
the improvement that would normally be assessed to the benefit district.
When this method is used the improvement is still a public facility and
available for use by other parties. However, there is no provision for
the requesting party to recover any expenses incurred by the improvement.
A water line to the Stimmel School area has been proposed in the past,
once by petition and once by a resolution on the city's part. Both actions
were protested out by the people who own the land between the existing
water line and Stimmel School. You are certainly welcome to attempt a
petition on the water improvement. I personally doubt that it would be
successful.
The two estimates of cost for the method you choose to use for the
request of the improvements are as follows:
1) Petition - charged to benefit district.
School property - $2,515.00
2) Cash deposited by requesting party.
Total - $7,397.50

The project would take approximately three months before the construction
contract could be awarded if the project was initiated by petition. If the
requesting party was financing the improvements, the construction contract
could be awarded within six weeks.
