Box 324 �Salina, Ks. 07401 27 August 1970 Salina City Commission 0/0 idorris c lson, City 11anager Salina, Ks. 67401 Oentlean: The Squires of Salina and Wichita region of the Sports Car Club of America would like to out on an autocross at the Salina raceway (old airport) Sunday, Oct. 166 I already have met with the PagodaCar Club which runs the drag races and they have relinquished to us that date. This autocross will be one of 3 being run by 1-.ichita region as the Schlitz Autoevoss Neries. Schlitz Beer is sponsoring several such series around the country through SCuA regions, Wiehita Region being one of those selected. The other 2 events will run in Wichita. Enclosed is a diagram showing what an autocross course looks like. This is not the exact course design we intend to run but is an idealized s?fetch of what such a course is like. It also shows the area of the Raceway we wish to use. An autocross is a closed -course event for automobiles, divided into the same classes used in SCCA racing. However, speeds generally are much.lo*:ger as the premium is placed on handling of an automobile thruugh a tight and twisty course. 'ihe course i intend to desi6n probably will allow smaller cars to reach 3rd gear and larger ones to get to 2nd bear, 50 or 60 zaph would be considered high speed in an autocross. Average speed will likely be in Lhe 20-30 mph range. This event will be covered by the same SCCA insurance policy, through Lloyd's of London, which covered the,SCGA races here. `ihe ,policy covers all SCCA events and is written to cover any participant, sponsor or property owner in a general statement. I£ you wish, I can obtain a copy of it (after our Squires secretary, who has it in his possession, returns from vacation). Also if you Irish, a version of the policy can be written which 6pecificall7 names the City of Salina as one of the insured An autocross generally is run for the benefit of participants rather than as a spectator-ori�rted event. Thus there is an entry fee to participate but no admission charge. Anyone who wishes to lust watch may do so for free. Entry fees go towards trophies, plaques and club expenses. Both the Squires and SCCA are non-profit organizations. Schlitz's interest, in this case, I believe is strictly a publicity tie-in. While I am requesting specific pormiss-on here for this event, I also would like to be able to run_ future autocrosses, on a smaller scale, for the Squires. We have been using the hi;h school parking lot for past events. While we wouid like to use the raceway, the Pagoda Car Club has prior claim on the strip which we recognize and we acknowledge that our opportunities to use the Raceway would have to be contir_6ent on the Pagoda sehedule. Therefore I also am asking permission to run Squires autocrosses at the naceway when the Pagoda schedule permits in the future. Regarding; insurance for the Squires events, they also are covered by the SCCA insurance. To bodily injury or property damage arising out of: (1) The ownership, maintenance, operation, use, loading, or unloading of any aircraft or watercraft; (2) Structural alterations which involve changing the size of or moving buildings or other structures, new construction or demolition operations performed by or on behalf of the Insured; C3) The consumption, possession or use of any article or product manu. factured, distributed, sold, installed or repaired by the Insured except as provided by Coverage C; . CONDITIONS 1. Premium. Prior to 12:01 A.M. of the day of each racing meet, the ncmed Insured agrees to give to the company at its home office or to its authorized agent a notice of intent to race, date of such racing meet and the type of cars participating in the racing most accompanied by the premium as set forth in the schedule for such racing meet. In the event a racing meet is cancelled by reason of inclement weather, im. mediate notice of such cancellation must be given to the company, or its authorized agent for the purpose of determining any premium refund. 2. Limit of Liability. Regardless of the number of (1) insureds under this policy, (2) persons or organizations who sustain bodily injury or property damage, (3) claims made or suits brought on account of -bodily injury or property damage, or (4) coverages of Insuring Agreement No. 1 involved: the limit of liability stated In the declarations Is the total limit of the company's liability for all damages as the result of any one occurrence. For the purpose of determining the limit of the company's liability, all bodily injury and property damage arising out of continuous or repeated exposure to substantially the same general conditions shall be considered as arising out of one occurrence. It Misrepresentation Clause. In the event Insufficient premium is paid for a racing meet because of misrepresentation by the Insured, whether or not de- liberate or intended, the Insured shall reimburse the company for any damages paid by the company, a percentage of the paid damages equal to the per. centage of Insufficiency in the premium paid for the racing meet Payment of premium insufficiency after an ocurrence shall not relieve the Insured from the responsibility of said reimbursement 4. Policy Period. This insurance applies only to bodily Injury or property damage arising from occurrences during the policy period at the premises stated in Item 3 of the declarations. 8. Persons Insured. Each of the following is an Insured under this Insurance to the extent set forth below: W The named Insured and any partner, executive officer, director or stock- holder thereof while acting within the scope of his duties as such, W Any person or organization engaged in operating, managing, sponsoring, or providing the premises for a racing meet (C) Any driver, owner or sponsor, including their employees, partners, as- soclates or assistants, of any vehicle entered irr a racing meet, but only with respect to bodily Injury or property damage to persons other than those insured hereunder, including any other driver, owners, sponsor, employee, partner, assist- ant or associate of such driver, owner or sponsor who has a vehicle in a racing meet G. Inspection and Audit The company shall be permitted but not obligated to Inspect the named insured's property and operations at any time. Neither the company's right to make Inspections nor the making thereof nor any report thereon shall constitute an undertaking, on behalf of or for the benefit of the named Insured or others, to determine or warrant thatzsuch property or opera- ations are safe. The company may examine and audit the named Insured's books and records at any time during the policy period and extensions thereof and within three years after the final termination of this policy, as far as they relate to the subject matter of this insurance. 7. Insured's Duties in the Event of Occurrence, Claim or Suit. A. In the event of an occurrence, written notice containing -particulars sufficient to identify the Insured and also reasonably obtainable information with respect to the time, place and circumstance thereof, and the names and addresses of the Injured and of available witnesses, shall be given by or for the Insured to the company or any of its authorized agents as soon as practicable. The named Insured shall promptly take at his expense all reasonable steps to prevent other bodily injury or property damage from arising out of the same or similar conditions, but such expense shall not be recoverable under this policy. B. If claim is made or suit is brought against the Insured, the Insured shall immediately forward to the company every demand, notice, summons or other process received by him or his representative. C. The Insured shall cooperate with the company' and, upon the company's request, assist in making settlements, in the conduct of suits and in enforcing any right of contribution or Indemnity against any person or organization who may be liable to the insured because of bodily Injury or property damage with respect to which insurance is afforded under this policy; and the insured shall attend hearings and trials and assist in securing and giving evidence and obtaining the attendance of witnesses. The insured shall not except at his own cost, voluntarily make any payment, assume any obligation or incur any expense other than for first aid to others at the time of an occurrence. 8. Action Against Company. No action shall Ile against the Company, unless -- -- ---- as a condition precedent thereto, there shall have been full compliance with all of the terms of this policy, nor until the amount of the Insured's obligation to pay shall have been finally determined either by judgment against the Insured after actual trial or by written agreement of the insured, the claimant and the company. Any person or organization or the legal representative thereof who has secured such judgment or written agreement shall thereafter be entitled to recover under this policy to the extent of the Insurance afforded by this policy. No person or organization shall have any right under this policy to join the company as a party to any action against the Insured to determine the Insured's liability, nor shall the company be impleaded by the insured or his legal repre- sentative. Bankruptcy or Insolvency of the Insured or of the Insured's estate shall not relieve the company of any of its obligations hereunder. 8. Other Insurance. The insurance afforded by this policy is primary Insurance, except when stated to apply in excess of or contingent upon the absence of other insurance. When this insurance Is primary and the Insured has other Insurance which is stated to be applicable to the loss on an excess or con- tingent basis, the amount of the company's liability under this policy shall not be reduced by the existence of such other insurance. When both this insurance and other Insurance apply to the loss on the same basis, whether primary, excess or contingent, the company shall not be liable under this policy for a greater proportion of the loss than that stated In the applicable contribution provision below: - A. Contribution by Equal Shares: If all of such other valid and collectible in- surance provides for contribution by equal shares, the company shall not be liable for a greater proportion of such loss than would be payable If each insurer contributes an equal share until the share of each insurer equals the lowest applicable limit of liability under any one policy or the full amount of the loss is paid, and with respect to any amount of loss not so paid the remaining insurers then continue to contribute equal shares of the remaining amount of the lou until each such Insurer has paid its limit in full or the full amount of the loss is paid. B. Contribution by Limits: If any of such other Insurance does not provide for contribution by equal shares, the company shall not be liable for a greater proportion of such loss than the applicable limit of liability under this policy for such loss bears to the total applicable limit of liability of all valid and collectible Insurance against such loss. 10. Subrogation. In the event of any payment under this policy, the company shall be subrogated to all the Insured's rights of recovery therefor against any person or organization and the Insured shall execute and deliver instruments and papers and do whatever else is necessary to secure such rights. The Insured shall do nothing after loss to prejudice such rights. 11. Changes. Notice to any agent or knowledge possessed by any agent or by any other person shall not effect a waiver or a change in my part of this policy or estop the company from asserting any right under the terms of this policy, nor shall the terms of this policy be waivered or changed, except by endorsement Issued to form a part of this policy. 12. Assignment. Assignment of Interest under this policy shall not bind the company until its consent is endorsed hereon; if, however, the named Insured shall die, such insurance as is afforded by this policy shall apply (1) to the named Insured's legal representative, as the named Insured, but only while acting within the scope of his duties as such, and (2) with respect to the property of the named insured to the person having proper temporary custody thereof, as Insured, but only until the appointment and qualification of the legal representative. 13. Cancellation. This policy may be cancelled by the named Insured by surrender thereof to the company or any. of its authorized agents or by mailing to the core any written notice stating when thereafter the cancellation shall be effective. This policy may be cancelled by the company by mailing to the named Insured at the address shown in this policy, written notice stating when not less than twenty days thereafter such cancellation shall be effective. The mailing of notice as aforesaid shall be sufficient proof of notice. The time of surrender or the effective date and hour of cancellation stated in the notice shall become the end of the policy period. Delivery of such written notice either by the named Insured or by the company shall be equivalent to mailing. 14. Declarations. Coverage 6-4otal Disability—Maximum 52 Weeks: To pay weekly Indemnity at the rate stated in the applicable benefit for the period of continuous total disability of'the insured who has sustained bodily injury during a racing meet provided (1) such disability requires regular and personal attendance by a licensed Physician, Surgeon, or Osteopath, and (2) such diability commences within thirty days after the date of the occurrence, and (3) any disability during the period of fifty two weeks from its commencement shall be deemed total dis- ability only if it continuously prevents the Insured from performing every duty pertaining to his occupation, and (4) the Insured is employed on a full time basis in a remunerative occupation at the time of the occurrence, and (5) dis. ability benefits shall commence immediately following the Elimination Period stated in the Declarations. Proof of Claim: As soon as practicable the injured person, or in the event of death, someone an his behalf, shall give to the company or its authorized agent written notice of claim containing particulars sufficient to identify the insured and also reasonably obtainable information with respect to the time, Place and circumstances thereof, and the names and addresses of the injured and of available witnesses, under oath if required; and shall after each request from the company execute authorization to enable the company to obtain medical reports and copies of records. Proof of claim shall be made upon forms furnished by the company unless the company shall have failed to furnish such forms within fifteen days after re- ceiving notice of claim. The injured person shall submit to physical examination by physicians selected by the company when and as often as the company may reasonably require. 4. Payment of Death Benefits: Autopsy --Coverage D Hereof: If the decedent insured be survived by a spouse, the death benefit is payable to such spouse; otherwise, to surviving child or children equally, if any; otherwise to surviving parent or parents equally, if any; otherwise the death benefit is payable to the decedent Insured's estate. The company shall have the right and opportunity to maka� an autopsy where it is not forbidden by law. 5. Payment of Indemnity—Coverage 0 Hereof: Weekly indemnity for total disability is payable to the Insured who is disabled. Subject to proof of claim, accrued weekly indemnity is payable every four weeks and any balance at m any capacity in any racing meet. 7. Death of Insured: If any insured dies, any insurance afforded under this endorsement with respect to any surviving insured shall be continued while the Policy is in effect. 6. Premlum Clause—Prior to 12:01 A.M. of the day of each racing meet, the named insured agrees to give to the company at its home office or to its authorized agent, a notice of intent to race, date of such racing meet accom- panied by the premium as set forth in Item 6 of the declarations for the Vehicle Class relevant to -the racing meet involved. It Action Against Company—No action at law or in equity shall 'be brought to recover on this endorsement prior to the expiration of sixty days after written proof of loss has been furnished. No such action shall be brought after the expiration of three years after the time written Proof of Loss is required to be furnished. .10. Limit of Lia illity—For bodily injury to any one Insured arising out of an occurrence, the limit of the company's liability for all benefits, expenses and indemnities shall not exceed 150% of the Medical Expense benefit. For bodily Injury to two or more insureds arising out of the same occurrence the limit of the Company's liability shall not exceed 200% of the Medical Expense benefit and shall be apportioned in the following manner: Each Insured receiving bodily injury shall be entitled to receive'an equal share of the limit of liability provided (1) such share does not exceed benefits due if this clause were not in effect, and (2) in the event any Injured insured's equal share is not paid by the Company, the unused portion thereof .shall be distributed by equal shares to the remaining injured Insureds who have rights of recovery remaining until the limits of the company's liability have been exhausted. The Breakfast Optimist Club feels that this activity has been a definite asset to the Salina Community and that there is a large interest in this type of Recreational Sport. We are proud to have had a part in instituting this program and have a great desire to see it continue. Our club, however; being involved with many phases of fund raising and boys work, finds a project of this size to be quite burdensom and time consuming when properly staffed. The Pagoda Car Club on the other hand has as it's only interest this type of activity and is able to devote it's entire energy and resourses to it's operation. We feel that with last years operation of the Salina Raceway, enough experience was gained that the Pagoda Club should be able to handle the entire project with a minimum of difficulty. We therefore, request that as indicated above, the City Commissioners give consideration to assigning the present license agreement to the Pagoda Car Club for the balance of the term of said agreement. The meet scheduled for Sunday, October 27th, 1965, completed this year's schedule. All facilities installed by the organization will be removed and area policed up as soon as possible.
