Dear Ms. Shiever:
Mitchell Communications Corp., a South Carolina Corporation, operates a
company known as Real Choice TV of Salina, located at 1815 S. Broadway in Salina.
Real Choice TV operates pursuant to agreements entered into with others who are
licensed to transmit radio and television signals emanating from points in the Salina area.
In these agreements Real Choice TV leases the right to transmit a number of television
channels throughout the area. A resident in the area can buy the right to receive these
TV signals for a specified price.
Since we offer a multiple of TV channels, and since there are similarities to a
cable television system in that cable television also offers a multiple of TV channels our
business is sometimes called "wireless cable." Congress had mandated that since cable
television systems use public right of way to lay or string coaxial cable from which it only
serves customers in communities where they 'have a permit to use the rights of way, a
cable television system must have a franchise and license from the community it serves.
Real Choice TV, and other companies like it, do not use the public rights of way,
but only use private property for which it negotiates specific rights to enter. Our
business is subject to licenses issued by the Federal Communications Commission as are
radio and television stations. We believe any local license or arrangement to do business
would be similar to that required of a radio or television station.
