landfill contractsN C O N T R A C T This Agreement entered into this October 31, 1966 , between The City of Salina, Kansas, a municipal corporation, hereinafter referred to as City, and O. K. Webster, hereinafter referred to as Webster. WITNESSETH: WHEREAS, Webster is the owner of the real estate herein- after described and the City of Salina desires to operate a munici- pal landfill on said real estate for the purpose of disposing of any and all refuse and waste materials. NOW THEREFORE, in consideration of the covenants and agreements herein contained and the mutual benefits to accrue to each of the parties, it is agreed as follows: 1. The City shall have the right to operate a municipal landfill for the purpose of disposing of any and all refuse and waste materials and to fill a portion of the Saline River bed, located on the following described real estate owned by Webster, to -wit: The Southwest Quarter (SW4) of Section Thirty (30) and the Northwest Quarter (NW4) of Section Thirty- one, both being in Township Thirteen (13) South, Range Two (2) West and the Southeast Quarter (SE'XA) of Section Twenty-five (25), Township Thirteen (13), Range Three (3) West, all in Saline County, Kansas. 2. The City will have complete control and management of the landfill area and of the landfill operation, and shall furnish all personnel'and equipment; and shall exercise con- trol over odor, flies and blowing trash so as to keep such nuisances to a reasonable minimum. 3. The City agrees to construct and maintain without cost to Webster all roads, buildings, fences, gates and other facilities necessary to the landfill operation. 4. The City will have full and complete rights to sal- vage any and all materials disposed of at the landfill. Pro- vided, Webster will have the right to salvage rubber tires and CONTRACT - 2 - tubes. The City will stack and reserve said tires and tubes so long as it does not interfere with operation of the landfill. 5. The City shall not start or knowingly permit fires to be started in,on or about the landfill without having first obtained permission from Webster. In the event of accidental fires, spontaneous combustion or fires started by unauthorized personnel or other persons, the City will not be responsible for resulting damage to crops, equipment or property other than that owned by the City. 6. All facilities and equipment constructed or installed by the City for use in the landfill operation will remain the property of the City and the same shall be removed within thirty (30) days following termination of this Agreement. 7. The City shall have the right to dig pits adjacent to the river bed being filled in order to obtain cover dirt. Such pits may be of sufficient number, 'size and location so as to be most.convenient and accessible to the landfill opera- tion. Such pits to be referred to hereafter as Borrow Pits.. When starting a new Borrow Pit, a minimum of 1 foot of top- soil shall be removed and reserved for use as the final cover on Borrow Pits or the river bed. 8. The City sahll be allowed adequate room on all sides of the river bed and Borrow Pits for convenient operation of equipment, movement of traffic and parking of vehicles. 9. The City agrees to fill the river bed and all Borrow Pits with compacted refuse, and apply a final cover of a mini- mum of one (1) foot of compacted soil. The final cover of soil to be placed at the discretion of the City. In the event of termination of this agreement, the final cover of soil will be applied to that portion of the river bed and Borrow Pits utilized in the landfill operation within ninety (90) days following such termination. Provided, in the event of the soil being frozen, rendering it impracticable to dig, the ninety (90) day's or remaining portion thereof shall be in CONTRACT - 3 - effect following complete thawing of the soil so that it .is workable. 10. The City reserves the right and privilege of tempor- arily suspending and/or moving the landfill operation to another location at any time administrative officials deem it necessary without advance notice to Webster. 11. This agreement shall be in effect until either party shall give written notice of cancellation by registered mail to the other party at least ninety (90) days prior to date of such cancellation. 12. The City will remove all trees along the river bed to a minimum depth of two feet below the grade level of the completed landfill. This Agreement shall be binding upon the parties hereto and his and its respective heirs, devisees „legatees, personal representatives and assigns. NOW THEREFORE, in consideration of the covenants and agreements herein contained and the payment of $500.00 for 250 lineal feet, more or less, of old river bed to D. E. Winslow, it is agreed as follows: 1. The City shall, have the right to operate a municipal landfill for the purpose of disposing of any and all refuse and }' hauled in packer truck bodies only, waste materials/and to fill a portion of the Smoky Hill River Bed, which has been by-passed by the Salina Flood Control Channel, located on the following described real estate owned by Winslow, to -wit: The West Half of the Southeast Quarter (W 1/2 SE 1/4) of Section Five (5) Township Fourteen (14) South, Range Three (3) West of the 6th Principal Meridian, in Saline County, Kansas. 2. The City will remove all trees along the West side of river bed to a minimum depth of four feet below the grade level of the completed landfill. This Agreement shall be binding upon the parties hereto and his and its respective heirs, devisees, legatees, personal representatives and assigns. KANSAS LEAGUE OF MUNICIPALITIES NATIONAL LEAGUE OF CITIES C O N T R A C T THIS AGREEMENT entered into this 22nd day of February, 1972, between the City of Salina, Kansas, a municipal corporation, of the first part and Joe Wilson, 1211 North Fourth Street, Salina, Kansas, of the second part shall become effective February 23, 1972. WITNESSETH: In consideration of the covenants and agreements herein contained and the payments to be made by Wilson to the City of Salina, Kansas, it is agreed as follows: 1. Wilson shall have the right to salvage all metals at the city landfill operation; and shall pay to the City of Salina, Kansas, monthly, Twenty-five dollars ($25.00). 2. Wilson shall be limited to the use of one truck and one.pi-ece of loading or hoisting equipment only in such salvage operation and shall not have more than two employees or helpers on the landfill site at any time. 3. Wilson, or his employees, shall not interfere at any time with the operation of said landfill by the City of Salina, Kansas, its agents or employees. 4. All labor and equipment used in such salvage operation shall be provided by Wilson. 5. The equipment used by Wilson in such salvage operation must be moved from one spot to another at the direction of the landfill attendant furnished by the City of Salina, Kansas. 6. Salvage work shall be done only during the hours the landfill is open to the public. 7. All salvage shall be loaded directly onto the truck furnished by Wilson. No other stockpiling shall be permitted. S. No burning shall be permitted in connection with the salvage operation. 9. It is understood and agreed that Wilson is an independent contractor in the conduct of such salvage operation and that the City shall incur no liability whatsoever for personal injury or property damage sustained by Wilson or other persons whomsoever; and Wilson agrees to protect and save harmless and indemnify the City of Salina, Kansas, from and for any and all damages which may be sustained by any and all of such persons on account of the operation of said salvage operation. Either party hereto may terminate this agreement upon ten (10) days written notice to the other. This agreement or any part thereof may not be transferred or assigned without the express consent of the City of Salina, Kansas, and its consent thereto endorsed hereon. Heath shall be limited to the use of one truck and one piece of loading or hoisting equipment only in such salvage operation and shall not have more than two employees or helpers on the landfill site at any time. 3. All labor and equipment used in such salvage operation shall be provided by.Heath. 5. The equipment used by Heath in such salvage operation must be moved from one spot to another at the direction of the landfill attendant furnished by The City of Salina, Kansas. 6. Salvage work shall be done only during the hours the landfill is open to the public. 7. All salvage shall be loaded directly onto the truck furnished by Heath. No other stockpiling shall be permitted. 8. No burning shall be permitted in connection with the salvage operation. 9. Each load salvaged is to be weighed on scales provided by Roets and duplicate copies of the scale tickets rendered the City each week; and payment shall be made by Roets to the City of Salina at the end of each month for the total tonnage salvaged. 7. Licensee shall pay to the City, through the City Clerk, the sum of $1.50 for each load of refuse delivered to said land- fill, which fee shall be payable monthly in advance on an agreed estimated basis. Estimated c number of loads per month. (2). City reserves the right to terminate this license at the end of any month upon ten days written notice to the Licensee, or at any time without notice if Licensee is in default in pay- ment of fees due hereunder or violates any of the terms of this agreement or ordinances of the city. (3). Licensee releases the City and its employees from any and all liability for damages or injuries sustained by Licensee or his employees in the use of the said landfill.
