ORDINANCE NUMBER 10-10550 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter -described has been timely complied with, SO NOW, THEREFORE, . BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -3", PLANNED SHOPPING CENTER DISTRICT and "PC -5" PLANNED SERVICE COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lot One (1) and Lots Three through Seven (3 - 7), Block One (1) of the Replat of Auburndale Addition to the City of Salina, Saline County, Kansas. shall become a part of DISTRICT "PC -3", PLANNED SHOPPING CENTER DISTRICT and Lot Two (2), Block One (1) of the Replat of Auburndale Addition to the City of Salina, Saline County, Kansas shall become a part of DISTRICT "PC -5" PLANNED SERVICE COMMERCIAL DISTRICT. Section 2. AMENDMENT. CONDITIONS OF APPROVAL. The use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "PC -3", PLANNED SHOPPING CENTER DISTRICT and "PC -5" PLANNED SERVICE COMMERCIAL DISTRICT regulations and development of the property shall also be subject to the following conditions, to wit, with Section 1 of Ordinance Number 01-10054 being amended as follows: 1. Development limitations shall be as follows: a. Development of Lot 2, Block 1 shall be limited to a lumber yard with outdoor storage plus those uses listed in the C-3 district regulations and shall be subject to all bulk and use limitations in the C-3 district, except that an outdoor garden center shall be permitted to cover an area equal to forty percent (40%) of the building floor area and a maximum building height shall be fifty (50) feet. b. Development of Lot 1 and Lots 3-7, Block 1 shall be limited to those uses listed in the C-3 district regulations and shall be subject to all bulk and use limitations in the C-3 district , except that on Lots 3-6 and Lot 1, less that portion added to Lot 7, Block 1 the maximum building height shall be forty (40) feet and the maximum building height on Lot 7, Block 1 and a portion of Lot 1, Block 1 more particularly described as follows: Beginning the Southeast corner of said Lot 7; - thence on an assumed bearing of N 00°21'20"E along the East line of said Lot 7 a distance of 284.26 feet; - thence N 44°40'55" W along said East line a distance of 14.13 feet to the Northeast corner of said Lot 7; N N z W cc 1 1 - thence S 89'43'10" E a distance of 194.26 feet; - thence S 45°54'07" E a distance of 14.44 feet; - thence S 00°21'20" W a distance of 286.27 feet to a point on the South line of said Lot 1; - thence N 89°07'34" W along said South line a distance of 194.70 feet to the Point of Beginning; shall be forty-six (46) feet. C. Signage on Lots I and 2 shall be limited to one (1) freestanding pylon sign per street frontage with up to two (2) signs and a maximum permitted sign area of two hundred sixty (260) square feet and a maximum sign height of forty (40) feet. Signage on Lots 3-7 (the outlots) shall be limited to one (1) pole sign with a maximum permitted sign area of one hundred twenty (120) square feet and a maximum sign height of thirty (30) feet. Fagade or'wall signs for individual businesses shall be subject to the C-3 sign regulations. d. Parking for retail uses shall be limited to five (5) space per one thousand (1,000) square feet of floor area unless an exception for additional parking is approved by the City Commission. 2. The developer shall be responsible for the installation of all off-site improvements on Ninth Street and Schilling Road shown on the revised preliminary development plan including the signalization of the Ninth Street and Riffel Drive intersection. 3. Development of Lot 2, Block 1 shall conform to the approved final site development plan, including landscaping, parking lot lighting, signage and proposed building elevations which are herein incorporated by reference. 4. Development of Lot 7 and a portion of Lot 1, Block 1 (the hotel site) shall conform to the approved final site development plan, including landscaping, parking lot lighting, signage and proposed building elevations which are herein incorporated by reference. 5. A final site development plan and final landscape plan for the remaining building lots (the remainder of Lot I and Lots 3-6) shall be approved by the Planning Commission prior to issuance of any building permits for those building sites. Section 3. That Ordinance No. 01-10054 and all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper. Introduced: June 7, 2010 Passed: ' June 14, 2010 AG.
