468 Railroad Right-of-WayOrdinance No. 468
An ordinance giving and granting to the Missouri Pacific Railway Company in Kansas it
successors, lessees and assigns the right-of-way through the city of Salina, Kansas and the right to
construct, build, maintain and operate a railroad and the right to use, possess and accept certain streets,
alleys and public grounds in the City of Salina, Kansas.
Be it ordained by the Mayor and Councilmen of the city of Salina:
Section 1. That the right-of-way be and the same is hereby granted to the Missouri Pacific Railway
Company in Kansas" it successors, lessees and assigns and the right to construct, build, maintain and
operate a railroad with such tracks and side tracks as it deems necessary for its use and the right to use,
possess and occupy the following specified and named streets, alleys, and public grounds in said city of
Salina with: Pine Street in said city from the western limits thereof through said city upon said street to the
eastern limits of said city with the right to cross any and all streets and alleys, intersecting or crossing said
Pine Street from the eastern limits of said City to the west side of Ninth Street in said city.
Bishop Street in said city from the western limits thereof through said city and all additions thereto
to the eastern limits of said street and across Ninth Street to the eastern side of said Ninth Street with the
right to cross any and all streets and alleys intersecting or crossing said Bishop Street.
Fourth Street in said city from the north side of said Pine Street south through said city to the
intersection of said Fourth Street with the Smoky Hill River with the right to cross any and all streets and
alleys intersecting and crossing said Fourth Street within the limits aforesaid and occupy all said streets
and alleys subject to the provisions and to all such police regulations as may be legally exercised by said
city.
Section 2. That this is hereby granted to the said The Missouri Pacific Railway Company in
Kansas its successors, lessees, and assigners for the term of ninety-nine years the absolute, right sole and
exclusion use and possession of in and to all that piece and parcel of ground and real property situated in
said city known and designated as the "Country Park" situated between second and third streets and
between Pine and Elm Streets in said city as appears in the recorded plat of said City and known as make
of therein Country Park with the right to build, construct and maintain and operate all tracks or side tracks
therein and the buildings, freight depots, and for all other improvements or uses for railroad purposes.
Section 3. That the rights privileges and grants given by this ordinance to the said Railway
Company, its successors, lessees and assigns shall be remain and in said Railway Company so long as
the same shall be used for the purposes in this ordinance specified for the purposes of said railway and
with reasonable rules and regulations hereafter made by the City of Salina in the exercise of its legal
persons.
Section 4. That the said "The Missouri Pacific Railway Company in Kansas" shall within six
months after completing this railroad to and into said city of Salina make, provide, and maintenance at is
own expense substantial and sufficient crossings and approaches over its railroad tracks for each street
crossing said tracks on said streets whenever thereafter requested so to do by said city.
Section 5. This ordinance shall take effect and be in force from and after its publication in the
Saline County Journal.
