Be it ordained by the Mayor and Councilmen of the City of Salina, Kansas. Section 1. That Section 1 of Ordinance No. 282 entitled "An ordinance prescribing limits within which no building shall be erected or constructed except of brick, stone, or other incombustible material, with fire proof roof," shall be amended so as to read as follows: "Section 1. That no person or person shall construct erected or cause to be constructed or erected on any part of any lot of the City of Salina (between Walnut Street and the north lines of Lots 69 and 70 Santa Fe Avenue and between Fifth and Seventh Streets and between nor upon any of the lots fronting upon Santa Fe Avenue between the north line of said lots Number 69 & 70, on Santa Fe Avenue and Pin Street, any building or any addition to any building before erected, or any open shed or any other building whatever, whether the same be enclosed or not, within the limits aforesaid, unless the outer walls thereof (which shall not be less than one foot in thickness) shall be composed of brick or stone laid in mortar or composed o ther incombustible material and not building shall hereafter be constructed or erected within the limits of this section specified except with a fire proof roof and with substantial fireproof walls of stone or brick laid in mortar or with fire proof walls of other incombustible material, and no building except such as described in this section shall hereafter be removed to the limits in this section specified or from on part of said fire limits in this section specified or from one part of said fire limits to another part of said fire limits specified in this section. Any person who shall be guilty of a misdemeanor and shall upon conviction thereof be fined therefore, in the sum of one hundred dollars, and each and every days continuance of such violation, after the first conviction therefore shall be a new and substantive offence against this section and it shall be a part of judgment in each case where conviction is had that said building or other structure be removed from said fire limits and the Police Judge shall issue his warrant to the Marshall of said City of Salina to remove any such building or other structure from the fire limits, provided however that this section shall not apply to premises not more than ten feet high which must be in all cases on the back part of the lot or lots. Section 2. That original Section 1 of Ordinance No. 282 be and the same is hereby repealed. Section 3. This ordinance shall take effect and be in force from and after its publication in the Saline County Journal. Approved August 2, 1886
