467 Issue BondsOrdinance No. 467 An ordinance relating to the issue of bonds. Be it ordained by the Mayor and Councilmen of the City of Salina, Kansas. Section 1. That the bonds of the City of Salina is issued in the sum of $2123.82 or so much thereof as may be necessary for the purpose of paying for the curbing and paving on the west side of Santa Fe Avenue from Iron Avenue south to the south line of Lot No. 116 on the west side of Santa Fe Avenue from Iron Avenue north to the north line of Lot No. 96 on the east side of Santa Fe Avenue from Iron Avenue north to the north line of the south half of Lot No. 91. The Mayor of the City is hereby authorized to sign and execute the bonds aforesaid due in one, two and three years in accordance with the provisions of law. Section 2. This ordinance shall take effect and be in force from and after its publication in the Saline County Journal. Approved November 4, 1885 Ordinance No. 467 An ordinance providing for and regulating the lighting of the streets of the City of Salina and for furnishing citizens of said city with light. Be it ordained by the Mayor and Councilmen of the City of Salina, Kansas. Section 1. That E.W. Pike or his assigns be and they are hereby authorized to use the streets, lanes, alleys, and public grounds of the City of Salina for the purpose of laying down pipes for the conveyance of gas in and through said City for use of said City and its inhabitants. Section 2. That the said E.W. Pike or his assigns shall have the privilege of laying pipes for conveying gas in said City for the use of said City and its inhabitant for the term of twenty-one (21) years from the date of the passage of this ordinance. That the said E.W. Pick or his assigns shall commence work thereof within three months from January 1, 1886 and shall proceed with the construction with due diligence without unnecessary delay and shall have the said gas works in successful operation within six months from the time of beginning work therein and shall keep the same in successful operation thereafter. Section 3. That said E.W. Pike or his assigns shall erect within the corporate limits of the City of Salina gasworks of sufficient capacity to furnish at all times, all the gas necessary for use in said City and shall manufacture a gas equal or superior to any standard gas, of sixteen candle powers. Section 4. That said E.W. Pike or his assigns shall lay down and maintain in mains or principal business streets and on all streets when there is guaranteed two subservient to each one hundred and twenty-five feet of mains necessary for such streets and shall make all connections necessary between its mains and street lamps and set all lamp posts without costs to the city, said City to furnish the lamp posts and necessary service pipes and stop corks. Section 5. That the said E.W. Pike or his assigns shall not charge for the use of gas furnished to the inhabitants, of said City, more than two and 50/100 (2.50/100) dollars per one thousand cubic feet. That the said E.W. Pike or his assigns shall not charge for gas furnished to the City for any number of street lamps, less than thirty (30) ordered by the City, to exceed $25.00 per lamp, per annum, for and additional number of street lamps exceeding thirty (30). Said E.W. Pike or his assigns shall not charge to exceed $22.50 per lamp per annum. Provided further that said E.W. Pike or his assigns shall not at any time charge for the use of gas that may be furnished to said City or to any of the inhabitants thereof, a price greater than is from time to time during said twenty-one years, charged for the same in cities of a similar size and with like facilities for the making and furnishing of gas. The said E.W. Pike, or his assigns, shall put up such lamp posts as are furnished by the City and light and extinguish them whenever necessary without expense to the City. Section 6. The said E.W. Pike or his assigns shall have the right to take up all pavements and sidewalks on streets, avenues, alleys, lanes, or public grounds and make such excavations therein as may be necessary to lay, repair and maintain the mains and all necessary connections therewith. Provided that the said E.W. Pike or his successors or assigns shall suitably guard and protect the same so as to prevent injury to persons or property by reason thereof. An the said E.W. Pike, his successors and assigns shall be liable for all damages occasioned by the removal of any pavement or sidewalk or street crossing, or the making of any excavations whether done by themselves, their lessees, contractors, employees or subcontractors in any degree. Section 7. That nothing in the ordinance shall be construed as giving said E.W. Pike or his assigns any claims for expenses or damages to which they may be subjected in consequence of the grading of any street, alley, park or other public ground within said City. Section 8. This ordinance shall be in force and take effect from and after its publication in the Saline County Journal. Approved November 16, 1885
