Be it ordained by the Tfayor and Coimcilmen of the city of Salina,
Kansas.
Sec. That the,' ' right of way be and the sane is hereby (;ranted to
the `' Rail vay Company to construct maintain and oper-
ate a single rail road track, and run its engines, car_,�,P_,,nd trains

Sec. Tai t the right of way and the use of those portions of t}1e
said streets iipon which the railroad tract: conLerriplated by this
ordinance shall be built, shall be, remain and vest in said rail-
way ror_pany so long as the saTM,e shall be used as in .this ordinance
specified for the purposes of said railroad, and with reasonable
rulesand regulations hereafter made,by the city of Salina, in the
exercise of its legal powers. Provided however the city of Salina,
reserves unto ,itself the right to grant to any other railroad cora=
}zany o, cot,.,panies the right of way to constriidt maintain and over-
ate a railroad track or tracks and run engines cars and trains up-
on the sable upon any> >rt 9,5-s c r _streets not 'actually used
and occupied by the said t�" e ;� Railway romparit by virtue
of this ordinance.
Sec. 6. That the 4mipm „_e P� , Railway (loripany shall make provide
and maintain at its own expense, s.irstantial and sufficient cross-

passage of water, and shall leave no obstructions on said streets
not necessary for the proper construction and operation of said
railroad tracks.
Sec. 4. That in case the property of any 'person or persons is dam-
aged or injured by reason of the cram herehy rude and such dam-
age is sustained shall be su,stan_tiated and adjudged by due pro-

sponsible for and pay all deriages and injuries so sustained and
adjudged.
Sec. 5. That the right of way hereby granted to the Un: r- n

Salina, Xo grant t}ie right of way over and across the track of
said`_` n Rae. f; Railway, on said streets, to any other rail-
road coripany_or companies•
Sec. 6. This ordinance shall be in force and continue so long as
said track shall be operated for the benefit of the piiblic and
shall take effect and he in force from and af�er its publication
in the Saline County Journal.
