Ordinance No. 523
An ordinance amending Section 8 of Ordinance Number 267 entitled "An ordinance relating to
misdemeanors."
Be it ordained by the Mayor and Councilmen of the City of Salina, Kansas:
Section 1. That section 8 of Ordinance Number 267 entitled "An ordinance relating to
misdemeanors," be and the same is hereby amended so as to read as follows: Section 8. It shall be
unlawful to obstruct, and all person hereby prohibited from obstructing and in any way encroaching into and
upon any sidewalks, street, avenue, alley, or other property of the City and from riding or driving across any
sidewalk with horses or cattle or other stock, and where any obstructions may be found upon any sidewalk,
street, avenue, alley or in other public places in the City, it shall be the duty of the Marshall immediately to
notify the owner or occupant of the premises fronting them or the person placing the same there, to remove
the same without delay and upon failure so to do. The Marshall shall have such obstruction removed at the
expense of the owner or occupiers of the property, and such expense, it not paid shall be a valid claim in
favor of the City against such person providing that persons occupying premises fronting thereon, shall be
permitted to occupy a space not exceeding three feet wide on the inside of sidewalks for the purpose of
displaying between the hours of 5 A.M. and 10 P.M. and may have such temporary use of the streets and
sidewalks as shall be actually necessary in receiving and shipping merchandise and provided further, that
any person erecting buildings in the City may for the time occupied in their erection and while it is
necessary to do so occupy a reasonable portion of the streets and sidewalks in front of the same for the
receiving and delivering of material and when it shall be necessary in any such case for the owner for the
property to take up and remove the sidewalks, he shall a the time of so taking up and removing,
constructing a temporary sidewalk not less than three feet wide for the public travel and conveniences and
case of open basements or excavations, the owner or occupier of the property upon which the same are
situated, or the person in charge of the excavations, shall provide the same with sufficient guards to protect
against accidents. That for every violation of this section of the ordinance, the person so offending shall
upon conviction be fined in a sum not less than five nor more than one hundred dollars; and if any person
shall continue any obstruction herein prohibited after being notified by the city marshal to remove the same
the fine imposed shall not be less than five dollars for every day he shall continue the same.
Section 2. The original section of ordinance number 267 be and is hereby repealed.
Section 3. That this ordinance will take effect and be in forced from and after its publication in the
Saline County Journal.
