That the right of way be,and the same is hereby granted the Missouri & Kansas Telephone Coripany,-of Topeka Kansas, its successors and_assigns,to erect and maintain lines of poles Iona, in, through under and across any public avenue,street,alley47dge and viaduct in the city,for the purpose of operating a Te hone exchange and Telephone lines. provided said lines of4ic s and wire's shall be so placpd,as to least interfere with use of said streets,avnnues and alleys. SECTION 2. e the poles of said Company shall be set in analley, they s placed as near the sides of the alley as practicable on the outer adze of the sidewalk just inside the curb stone, and on the line dividing; the lots one from the other; and in no ease to be so placed as to obstruct the drainage of ;hp streets or to interfere with any surer. SECTION S• No poles or wires of any +electric li;;ht,Telegraph or Electric Motor Comp an�,shall be erected on the same side of any street or alley,where the said Telephone Company has,already placed A,Jine of poles or other fixtures for carrying; its wires. provided this shall not apply to the City Fire Alam Telegraph line. Hereafter, the wires of all Electric I,ight,Telegraph and Elec- tric Motor Comnani?s,to be erected or strum; at an angle across the wires of said Telephone Company,and shall not in this ease,or any other,be allowed to approach thA wires of said Telephone ComDa Company ny nearer than'three feet. Nor shall.the said Telephone�,be allowed to,iplace its wires nearer than three feet to the wires of said :� other Companies. In case of the violation of the requirements of this section it shall be the duty of the Marshall to notify the offending Company to remove its wires,poles or fixtures so erected in violat inn hereof,within three days;and on failure to comply with such notice, it shall be the duty of the aipMarshall to remove the same forthwith,at the expense of the offending company. SKCrIAN 2. The rights and privileges Iereby granted to said Company shaia, bOfor the period of :+j C) years. S9CTION 5.1 It is agreed on the paxt of said Telephone Company to furnish the city, of� ) free telephones and all the ihstrurnents needed for fire, police and executive service of -said city,at the regular business rates,in lieu of any special license,occupation tax or special assessment of any sort,that may be levied upon them;said telephones to be located by the Council. ERCT LON 6. The T alephone Company shall remove its wires, afte r forty-eight (48) hours notice,on request of thell' Marsahll,to permit moving of houses along; the streets;all at the expense of the mover. SFCTIhN 7. Any person who shall,at any time,enrelessly or willfully injure,dama;e,destroy or deface the structures or prop- erty of *aid ura6te-es and their associates,erected for the purposes set forth in this ordinance,or who shall, in any manner, will fully IIyy ! (� t7 C interrupt or interfere with such telephonic communication and tele phone plant,or who shall violate any of the provisions of this or- dinance,sholl be dAemed guilty of a misdemeanor,and shall be pun ished by a fine of not less than ten dollars (tlO) nor more than one hundred dollars (tlOO).
