AN ORDI ANOE to prohibit the sale bf intoxicating liquor and to pro-
hibit and suppress places where intoxicating liquor is sold.
..BE IT ORDAINED by the mayor and councilmen of the city of Salina:
Section I. It shkll be unlawful for any VIII person within the city -of Salina
whether proprietor,owner,manarer,clerk,servant or agent,to sell or barter

any intoxicating liquor; and any devic or shift by which any*. ntoxicat
ing liquor is parted with for a consideration shall be deemed and held
to be a sale within the meaning of this ordinance.

Sec. 2. It shall be unlawful for ny person directly or indirectly

Sec.3.0 on complaint in writing aid under oath ,made before the ''olice
��udge,charging any person with keeping or maintaining,or with aiding, and
abetting in keeping or maintaining,in the city of `'alina,a place where

said liquors shall be ordered to be destroyed by the city marshal".,who
shall.forthwith execute such order.

Sec.4. This ordinance shall not apply to any lawful sale made by a
druggist,having a permit from the Probate JudgeofSaline County,Kansas,
to sell intoxicating liquors for medical,scientific,or mechanical pur-
poses,notj�, to any physician lawfully and regularly engaged in the prac-
tice of his pro'ffession who lawfully preseribes or administers intox-
icating liquors -as a medicine.
"ec. 5. Whiskey,wine,brandy,rum,'gin,beer,hop tea,hop tea tonic,
and all other liquors,or mixtures therb of,by whatever name called,;,^that

Sec.6. In prosecutions for the vjiolation of this ordinance it shall

not,be necessary to state in the complaint the particular kind of liq-
uor sold,nor the name of the person ta, whom sold;and it shall not be
necessary to describe the place where!!sold, except in'prosecutions under
sections two and three; and it shall not be necessary in the first in-
stance for the city to prove that thel',l'party charged did not have a permit
to sell intoxicating liquors for the excepted purposes.
Sec.7. Any person villating anyl'„of the provisions of this ordinance
shall be deemed guilty of a misdemeandr,and upon conviction thereof,shall*`
be fined in any sum not more than one';Ilhundred dollars,or by imprisonment
not exceeding three months,or by both„I!such fine and imprisonment,for the
first offense; and by a fine -.o -f not mdre than one hundioad dollars and
imprisonment for not more than three rqonths upon conviction for every

subsequent offense after the first. j
Sec.8. Section 49 of ordinance 6$5 is hereby repealed;save as -to
pending prosecutions,with reference to which it shall continue in full
force and 'effect. u
Sec. 9. This ordinance shall take effect and be in force from and
after its publication once in The Salina Dally Republican.
