921 Sale of Intoxicating LiquorOrdinance No,'''i 2, f An ordinance prohibiting the sale and barter of intoxicating liquors, and to prohibit and su*press places where.intoxicatin,g liquors are sold, bartered, and given away, or kept for sale barter or gift, and repealing ordinance No, 76N. Be it ordained by the Mayor and councilmen of the city of Salina, Kansas. Section 1, it shall be unlawful for any person in.the city of Salina Kansas, to sell or barter any intoxicating liquors and any shift or devise by which any intoxicating liquor)d is parted with for a consideration shall be deemed and held to be a sale within the meaning of this ordinance. Section 2 It shall be unlawful for any person directly or indirectly to keep or maintain, or aid or assist in keeping or maintair4ng any place in said city of Salina Kansas, wherein intoxicating liquor)i is sold bartererl or given away, or where intoxicating liquor is kept for the purpose of sale,b'arter,or gift. f Section a This ordinance shall not apply to any lawful sale made by R a druggest having a permit -from the probate judge of Saline county Kansas to sell intoxicating liquors for medical, scintific or mechanical purposes, or to the keeping of liquors for such purposes, or to any physician lawfully and regularly engaged In the practice of his profession who lawfully prescribes or administers intoxicating liquors as a medicine« Section,4 Whisky, Wine, Branny, Beer,Rum, tin, Hop tea, Hop Tea Tonic, Fail Malt, .or any mixtures or imitations thereof, by whatever name called shall be held and deemed to be intoxicating liquors within the meaning of this ordinance. Section R In proseettions under this ordinance it. shall not be necessary' y to state in the complaint, the particular kind of liquor sold, bartered or given away, or kept for sale barter or gift, nor the name of the person to whom sold bartered -or given, and it'shall not -be necessary to d4c'ribe the place' where sold bartered 'ar given away, except in prosecutions under section two of this. r.�.• ordinance, and it shall not be necessary in the first instance for the city to prove that the party charged did not have a permit to sell intoxicating liquors for the excepted purposes. Section a Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction be- fore the police court for such offence shall be fined in any sum not less thanfivedollars nor more that, fifty dollars and shall be adjudged to pay the costs of prosecution and stand com- mitred to the city prison or the county jail until such fine and costs are paid. Section 7 That ordinance No 766 of the published ordinances of said city of Salina Kansas be and the same is hereby repealed. Section 8 This ordinance shall take effect ang be in force from and after its publishtion once in the Salina Sun a weekly newspaper DI Published in Salina Kansas. 7
