point about four hundred feet east from the said point of com-
mencement. Thence in a northeasterly-direetion in,a curare line
aceross said Elm s3treet, and along- and upon Fourth street to a
point where the some can form an Intersection with the line of
the Salina and South Western Railway as the same 1s now located.

Section 2

That said spur shall be constructed and maintained at
the established grade in all streets an4 alleys.
Section $.
That sa14 Railway Company shall construct and maintain
suitable crossings over slid spur.at all street and alley cross -
Ings: -and also proper culverts and water ways along and across

said spur wheriev®r'and wherever required by the Mayor and council-
men of the said city of Salina, said , crossings, culverts, and
water -ways, shall be constructed and maintained under the sup-
ervision of and in accordance with the directions of the city
engineer of the said city of Salina.
Section 4,
The right of war, and the use of the streets and alleys de-
seribed, and upon which the said spur hereby authorised to be
constructed; shall be built, shall remain and vest in said Railway
Company, its successors and assignso so long as the some shall
be used as aforesaid for the purpose of constructing and vperat-
,ins a spur for said Railway* and subject to all rules, ordinances,
and regulations made by the Mayor and Councilmen of the said
city of Salina., in the exercise of the lawful powers of said city.
Provided b.owever, that the said city shall at all times have the
right to make provision For other Railways or street'Railways to
cross the 'said spur• and to provide for other streets and alleys

than those now in existance to cross the said spur without being
required.to pay damages therefor,
Section 6,
This ordi.nasice and the grant hereby made is upon those
t
express conditioust.thet the sold spur shall be costructed com-
pleted and in operation within six monthes from the taking effect
of this ordinance, and that the sold Railway Company will deliver
free of Switching charges any carload lots of freight received
by it for.troAsportation to the said Qity of Salina, on the said
spur for the purpose of being unlosadedo at the request of the
consignee of such freight, and will fUrther deliver.on.said spur
any -carload lots of freight receivedInthe said city of 'Salina
by any of the other Railssoads running into the said city, for

the purpose of being unloaded, at the request of the consignee '
thereof upon payment -by the said consignee of the usual switching
charges for'hike services, and shall also set in and upon said
spur empty cars of its"own or of that of other roads Inlike men-
ner aiid for like charges; for the:purpose of being loaded in the
said citys when requested so to do by the party intending to ship
such freight, and in case the said Railway Company shall fail,
neglect,or refuse to build and construct said spur within said
time or shall fail, neglect, or refuse to comply with,Yjl any of
the oy(ther provisions of this section, then and in that event
all rights hereby granted shall revert to and revest in the said
city of Salina.
Section R,%
That ordinance No,, 895 be and the same is hereby re-
pealed.
Section 7
This ordinance shall take effect and be in force from and
anter its publication once in the Salina Daily Republican Journal
published in the said city of Salinas
