1658 Improve Tenth Street(Published. in the June , 1912) ORDINA.NCR NOW An ordinance providing for the paving, curbing guttering and exca- vating of Tenth street, in the city of Salina, between the south line of South street and the tsouth line of Morrison avenue speci- fyin the manner of construction and providing for the cost thereof and the manner- of payment. 'Whereas, there has been presented to the mayor and councilor a petition requesting said mayor and council- to pave, curb, gutter and excavate Tenth street, in the city of Salina,. Kansas, between South street and Morrison avenue; and, 'Whereas,, said petition has been found by said mayor and council to contain the names of a majority of the resident property owners owning both sidesof F: property fronting on4aid Tenth street between the limits above defined; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Tenth street, in the city of Salina, Kansas, between the south line of South street and the #Ath line of Morrison avenue, be paved, with such material as the mayor and.council may hereafter designate and select, as herein. z� after provided, said pavirg to be,j�-- /Jeet in width from gutter to -gutter, except that at the intersections.of streets and alleys such paving shall extend from lot lli`nee o l t line on said Tenth street. Sec. 2. That it is necessary,�tha said Tenth street, between the limits defined in section one hereof, be curbed and guttered on both. sides thereof with cement curbing and guttering, according to the speci» ficat,ions hereinafter provided for, the curb part of the same to be six inches in thickness and the gutter part Ahereof to be thirty (30) inches, more or less, from the back edge of such curb to the paving line on said street, and -the lot line edge of such curbing shall be set feet from and parallel with the center line of said street north and south; Provided, that at the intersections of streets and alleys such curb and gutter shall return to the lot line of said street. Sec. 3. That all ezcavting, filling and rolling necessary for the proper construction of said paving, curbing and guttering be done, and such paving, curbing and guttering shall be constructed according to the Tenth established grade of said-treet, as heretofore or hereafter established by the ordinances of said city. Sec. 4. For the work and improvement herein provided for, the city engineer of the city of Salina shall make and file with the city clerk of said city, on or before the1--day of June, 1912, plans and specifications for the paving of said street with asphaltic -concrete.; sheet pavement, on f ive inch concrete ant oft issaft Ell base, and for brick block pavement on five inch concrete base, with sand filler„ and for the curbing and guttering of said street with cement curb and gutter of the dimensions, substantially, hereinbefore described; and on or before the cP-"4!;-'�_ day of June, 1912, said city engineer x shall file with said city clerk estimates of the cost of paving, curbing and guttering said street with the different kinds of material aforesaid, and of the dimensions aforesaid. Sec. 5. That after such plans and specifications shall have been filed with the said clerk, as aforesaid, said clerk shall advertise for bids or proposals for the paving m of said Tenth street with the dif- ferent kinds of street paving named and specified in the preceding section hereof, and for the curbing and guttering of said street, of the material and dimensions aforesaid, said ad�ve—r-t-isement to be published in the official city paper for at least re -issues thereof, and said bids or proposals shall be filed with said city clerk on or before the day of June, 191?; and after the receipt of such bids or pro- posals, the mayor and council shall select from the kinds of street paving so specified in section four hereof, and on which bids shall have been received as aforesaid, the kind of paving to be used on said street, and may, and are hereby authorized, to let the contract for the paving of said street with the material so selected, and for the curbing and guttering,of said street, to the most satisfactory and responsible bidder, as determined by the said mayor and council, for the kind and character of paving which shall be determined upon -by the said mayor and council, the said mayor and council reserving the right to let the contract or contracts for the paving and excavating separately from the curbing and guttering cr to let the contract for all of such improve- ments to one party, and to reject any and all bids. Sec. 6. After the passage of this ordinance, the mayor and council shall appoint three disinterested householders, who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation for the improvements herein provided for,shall_, within ten days after having been notified of their appointment, pro- ceed to appraise said lots and pieces of ground liable to taxation, without regard to any buildings or improvements thereon, and after making said appraisement shall return the same to the mayor and council at the first meeting thereof after such appraisement shall have beenulsotx completed, and after said appraisement is returned to the mayor and council the said mayor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper., and at said special session the mayor and council shall, if they deem it just and proper, alter or change such xpmdmi appraisement. Sec. 7. For the purpose of paying for the work and improvement in this ordinance provided for, the mayor and council are hereby authorized and directed to issue bonds of the city of Salina,, in an amount not to exeeed the contract price of such work and improvement, and to run for a period of ten years and be payable in" equal annual installments, x together with interest not to exceed five (5) per cent per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become due*the mayor and council.shall each year, during- the life of said bonds, levy an assessmentzagainst the lots and pieces of ground liable to taxation for the improvements herein provided for in an amount sufficient to pay the principal and interest for that year; Provided: that for the purpose of defraying the cost of improving the squares and areas formed by the crossing of streets and intersections of alleys, for which the city a liable, the assessments shall be made against all the taxable property of the city; and the city clerk shall certify such. assessments, as they are severally mde, to the count; clerk of Saline county, Kansas, at the same time and in the same manner as other city taxes are certified, and the said assessments shall be liable to the same penalties and rebates as other city taxes.
