1657 Improve Mulberry Street(Published in - the June, 1912.) ORDINANCE NO. 10' An Ordinance providing for the paving, curbing, guttering and excava- ting of Mulberry street between Santa Fe avenue and Ninth street, in the city 'of Salina, Kansas, specifying the manner of construct- ion and providing for the cost thereof and the manner of paymatt. Whereas, there has been presented to the mayor and council a petition requesting said mayor and council to pave, curb, gutter and excavate Mulberry street, in the city of Salina, Kansas, between the west side of Santa Fe avenue and the east side of Eighth street; and, Whereas, said petition has been found dm by e mayor and council resid to contain the names of a majority of the/property owners owning property fronting both sides of said Mulberry street between the limits above defined; and, Whereas, by resolution duly adopted on the 15th day of April, 1912, said mayor and council have declaredthat they deem it necess- ary to pave, curb and gutter said Mulberry street between the west line of Eighth street and the east line of Ninth street; and, Whereas, said resolution was duly published for,ten consecutive days in the "Salina Evening Journal", a daily newspaper published in the city of Salina and the official city paper of said city of Salina; and, Whereas, a majority of the resident owners of property liable to taxation and assessment for the cost of such street improvements c A did not withinv twenty days. from such last publication file with the city clerk of said city their protest agaisnt such improvements; therefore, Be it ordained by the mayor and councilman of the city of Salina: Section 1. That it is necessary and hereby ordered west street, in the city of Salina, Kansasobetwee^n_ the xxxtb line � of Santa Fe avenue and the east line of Nirith street be paved, with such material as the manor and council may hereafter design add s hereinafterprovided, said paving to be M,--R-feet select, a in width from gutter to gutter, except that atthe intersections of streets and alleys such paving shall extend f2un tok toAlot lirE on said Mulberry street. Sec. 2. That it is necessar that said Mulberry street, between the limits defined in section one hereof, be curbed and.guttered on i both bides thereof with cement curbing and guttering, according to the specifications hereinafter provided for, the curb part of the same to be six (6) inches in thickness and the gutter part .thereof to bethirty (30) inches, more or less, from the back edge of rich curb to tie paving line on said street, and the lot line edge of such curbing shall be set�Z�from and parallel .with the center V z 4 line of said street east and west;. Provided, that at the intersections of streets and alleys such curb and gutter shall return to the lot line of said street. Sec. 3. That all excavating, filling and rolling necessary -for the proper construction of said paving, curbing and guttering shall be done, and such paving, curbing and guttering shall be constructed ac- cording to the established grade of said .Mulberry street, as hereto- fore or hereafter established by the ordinances of said city. Sec. 4. For the work and improvementjherein provided for, tse city engineer of said city of Salina shall make and file with the city clerk of said city, on or before the I�CT__day of June,1912, plans and specifications for the paving of said street with asphaltic -concrete sheet pavement, on five inch concrete base, arseb- aw,adaa Wiand for brick block pavement on five inch concrete base, with sand filler, and for the curbing and guttering of said street with cement curb abd.gutter of the dimensions, substantially, hereinbefore described; and on or before the asci day of June, 1912, sadd city engineer shall file with said city clerk estimates of the cost of paving curbing and guttering said street with the differentkinds of material aforesaid, and of the dimensions aforesaid. Sec. $. That after such plans and specifications shall have been filed with the said clerk, as aforesaid, said clerk shall advertbee for bids or proposals for the paving of said 2nnIk Mulberry street with the different kinds of street paving named and specified in the preceding section hereof, and for the curbing and guttering of aaid street, of the material and dimensions aforesaid, said adveerrt-i-s-ement to be published in the official city paper for at least issues thereof, and said bids or proposals shall be filed with -said city clerk on or before the .24 -4y -day of Jun6, 1912; and after Vh a receipt of such bids or proposals, the mayor and council shall select from the kinds of street paving so specified in section four hereof, and on whi& bids shall have been received as aforesaid, the kind of pavin& to - be used on said street, and ,may, and are hereby authorized, to lot the contract for the paving of said street with the material so selected, and for the curbing and guttering of said street, to the most satisfactory and responsible bidder, as determined by the said mayor and. council, for the kind and charqcter of paving which shall be determined upon by the said mayor and council, the said mayor and council reserving the right to let the contract or con. tracts for the paving and excavating -separately from the curbing and guttering or to let the contract for all of such improvements to one party, and to reject any and all bids. Sec. 6. After the passage of. this ordinance, the mayor and council shall appoint three disinterested householders, who, after having taken an oath to faithfully and . impartially appraise all lots and pieces of ground liable to taxation for the improvements herein provided for, shall, within ten days after having been noti. Pied of their appointment, proceed to.appraise said lots and pieces of ground liable .to taxation, without regard to any buildings or improvements thereon, and after making said appraisement shall re- turn the same to the mayor and council at the first meeting thereof after such appraisement shall have been completed, and after said appraisement is returned to the.mayor and council the said mayor and council shall designate a time for holding a special session for the purpose of hearing complaint_ and equalizing said appraisement, of which special session due notice shall be given in the officil city paper, and at said special session the mayor and council shall, if they deem it just and proper, alter or change such appraisement. Sec, 7. For the purpose of paying for the work and improvement in this ordinance provided for, the mayor and council are hereby authorized and directed to issue bonds of the city of Salina, in an. amount not toexceed the contract price of such work and improvement, and to run for a period of ?---rears and be payable in equal annual installments, togeth§r with interest not to exceed five (�) per cent per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become dta the mayor and counci& shall each year, during the life of said bands, levy an.assessment against the lots and pieces of ground liable to taxation for the improvements herein provided for in an amount sd'ficient t6 pay the principal and interest for that year; Provided: that for the purpose of defraying'the cost of improving the sq%pares and areas formed by the crossing of streets and intersections of alleys, $s which the city could be liable, th® assessments shall be made against all the.taxable property of the city; and the city clerk shall certify such assessments, as they are severally mad®, to the county clerk of Saline county, Kansas, at the same time and in the same manner. as other, city taxes are certified, and the said aissessmert s shall be liable to the same penalties and rebates as other city taxes, Sec.
