1656 Improve Morrison Avenue(Published -in the 1912)
ORDINANCE NO.
An Ordinance providing for the paving, curbing, guttering and exca-
vating of Morrison avenue from the eabt line of Tenth street to
the we.st line of Ninth street, specifying the manner of construct-
ion and providing for the cost thereof and the manner of payment.
Whereas, there has been presented to the Mayor and Council a
petition requesting said Mayor and Council to pave, curb, gutter
and excavate Morrison avenue in the city of Salina, Kansas, betweem
the east line of Tenth street and theWt.4,k line of Ninth street.; and
Whereas, said petition has been found by said Mayor and Council
to contain the names of a majority of the resident property owners
owning property fronting on both sides of said Morrison avenue between
the limits above defined; therefore
Be it'ordained by the Mayor and Council of the city of Salina:
Section 1. That it is necessary and hereby ordered that Morrison
avenue in -the city of Salina, Kansas, between the east line of %enth
street and the .*-Vst line of Ninth street, be paved, with such material
as the Mayor and Council may hereafter designate and selett, as here -
i naf ter provided, said paving to beliie-&,:aQ feet in width from
gutter to gutter except that at the intersections of streets and
alleys such paving shall extend to the lot line on said Morrison
avenue.
Sec. 2. That it is necessarythat said Morrison avenue between
the limits defined in section one hereof, be curbed and guttered on
both sides thereof with cement curbing and guttering, according to
the specifications hereinafter provided for, the curb part of the
same to be six (6) inches in thickness and the gutter part thereof
to be thirty (30) inches, more or less, from the back edge of such
curb to the paving line on said street, and the lot line edge of such
curbing shall be set feet from and para-
llel with the center line of said street east and west; Provided, thet
at the intersections of streets and alleys such curb and gutter shall
return to the lot line of said street.
Sec. 3. That all excavating, filling and rolling nec_6ssary for
the proper construction of said paving, curbing and guttering r be
done, and such paving, curbing and guttering shall be convtructed-
according to the established grade of said Morrison avenue, as hereto-
fore or hereafter established by the ordinances of said city.
Sec. 4. For the work and improvementSherein provided for, the
city engineer of the city of Salina shall make and file with the
city clerk of said city, on or beforo the Ig day of Junef1912, plans
and specifications for the paving of said street with asphaltic-
bonetete MW
sheet pavement on five inchf concrete =wt -
and for brick block pavement on five inch aon-
creje base, with sand filler, and for the curbing and guttering of
said street with cement curb and gutter of the dimensions, substan-
tially, hereinbefore described; and on or befor6 the su
day of June, 1912, said city engineer shall file with said city clerk
estimates of the cost of paving, curbing and guttering said street
with the different kinds of material aforesaid, and of the dimen-
sions aforesaid.
Sec. 5. That after such plans nd specifications shall have
been filed with the said clerk, as aforesaid, said clerk shall adver-
tise for bids or proposals for the paving of said Morrison avenue
with the different kinds of street paving named and specified in the
preceding section hereof, and for the curbing and guttering of said
street, of the material and dimensions aforesaid, said advertise-
ment to be'published in the official city paper for at least
issues thereof, and said bids or proposals shall be filed with Us
city clerk on or before the ay of June, 1912; and after the
receipt of such bids or proposals, the mayor and council shall select
from the kinds of. street paving so specified in section four hereof,
and on which bids shall have been received as aforesaid, the kind of
paving to be used on said street, and may, and are hereby authorizedt
to let the contract for the paving of said street with the material
so selected, and for the curbing and guttering of said street, to
the most satisfaftory and responsible bidder, as determined by the
said mayor and council, for the kind and character of paving shich
shall be determined upon by the said mayor and council, the said maytr
and council reserving the right to let the contract or contracts for
the paving and excavating separately from the curbing and gutterktg
or to let the contract for all of such inprovements to one party, and
to reject any and all bids.
Sec. After the passage of this ordinance, the mayor and
council shall appoint three disinterestdd householders, who, after
having taken an oath to faithfully and impartially appraise all lots
and pieces of ground liable to taxation for the improvements herein
provided for, shall, within ten days after.having been notified of
their appointment, proveed to appraise said lots and pieces of ground
liable to taxation, without regard to any buildings or improvements
thereon, and after making said appraisement shall return the sane to
the mayor and council at the first meeting thereof after such appaise-
ment shall have been completed, and after said appraisement is re-
turned to the mayor and council the said mayor and council shall de-
signate a time for holding a special session for the purpose of hearing
complaints and equalizing said appraisement, of which special session
due notice shall be given in the Official -city paper, and at saki
special session the mayor and council shall, if they deem it juo; and
proper, alter or change such appraisement.
Sec. ?. For the purpose of paying for the work and improvesent
in this ordinance provided for, the mayor and council ate hereby
authorized and directed to issue bonds of the city of Salina, in an
amount not to exceed.the contract price of such work and improvement,
and to run for a period of years and be payable in
equal annual installments, together with interest not to exceed five
per cent per annum, which bonds shall be made payable at the
Fiscal Agency of the State of Kansas; and for the purpose of paying
principal and interest on said bonds as they severally become due the
mayor and council shall each year, during the life of said bonds, levy
asp assessments against the lots and pieces of ground liable to taxation
for the improvements.rein provided for in an amount sufficient to pay
the principal and interest for that year; Provided: that for the pur-
pose of defraying the cost of improving the squares and areas forced by
the crossing of streets and intersections of alleys, for which tk city
walff be liable, the assessments ahall be made against all the taxa-
ble property of the city; and the city clerk shall certify such assess-
ments, as they ar6 severally made to the county clerk of Saline
county, Kansas, at the same time and in the same manner as other city
taxes are certified, and the said assessments shall be liable to the
same penalties and rebates as other city taxes.
Sec. 8. This ordinance shall take. effect and be in force fro4i
