ORDINANCE N0.
An Ordinance relating to and apportioning and levying special assess-
. rents on certain lots and pieces of ground in the city of Salina,
Kansas, to pay the cost of paving, curbing, guttering and excavating
parts of certain streets in said city; and relating to and providing
for the collection and payment of such special assessments.
Be it ordained by the Mayor and Councilmen of the city of Salina:
Section 1., For the purpose of paying the cost of paving, curbing
guttering and excavating College avenue, in the city of Salina, Kansas,
between the blocks thereof bounded by the south side of. Ash street and
the north side of State treet; the south side of State street and the

north side of University Place; and the south side of University Place._
and the north side of Walnut street; and the cost of paving, curbing,
guttering and excavating Elm street, in said city, between /Cthe blocks
thereof bounded by the west line of Seventh street and the east line (f
Eighth street and the west line of Eighth Otxei�t_and the. east line of
Ninth street there are hereby levied and assessed, for each of such
blocks separate on the property liable therefor—being all the lots

and pieces of ground lying on either side of said College avenue and
Elm street, respectively, to the center of the blocks, on either side
thereof4special assessments covering the cost of such work and improve-
ment,, said special assessments being based on the special valuation and
appraisement of said lots and pieces of ground heretofore made by three
disinterested appraisers appointed by the mayor and council, to appraise
said property without regard to the buildinCD
gs or improvements thereon,
which .said appraisement is hereby referred`to and made a part of this,
ordinance; and the lots and pieces of ground liable for such special
assessments and the several amounts levied, apportioned and assessed
against each of them for the purpose aforesaid, are described and, de-
signated as follows, to -wit:

Sec. . Said amounts levied, apportioned and assessed as afore-
said shall be due and collectible in ten (10) equal annual installments,

the first installment becoming due in the year 191 and one of said in-
stallments falling due each year and every year thereafter until all are
paid, and all to be collected with interests as in this ordinance pro-
vided: Provided, that the oiner of any piece of property liable for eny
such special assessment may redeem his property from such liability by
paying into 'the city treasury the entire amount chargeable against the
same, as in this ordinance specified, at any time within thirty (30)
days after the publication of this ordinance and before -the issuance of
the bonds of said city in payment of the cost of sa.i d. improvement , and
his property so ' pa.id on shall not thereafter be liable for the cost
of said improvement, nor for any part of the said bonds.
Sec. . There is hereby further, levied and assessed agaTinst eadl
lot and piece of ground described in sections 2, 39 5(and 0of this
ordinance five (5) per cent interest per annum on all of said install-
ments therein mentioned, from the date of the bonds to the time of the
collection of each of said installments, as provided by la -.v, which shall
be collected annually at the same time and in the same manner as said
installments, and after the takim- effect of this ordinance, and after
the issuance of the bonds as herein provided, it shall be the duty of
the city clek of said city to annually, at the same time other city
taxes are to be certified, and until all of said taxes and assessments
so apportioned and levied have been certified, to certify to the county
clerk of Saline county, Kansas, a full list of all property liable to
taxation and assessment .for such work and improvement, except such pro-
perty on which the special assessments aforesaid have been paid, as heL--
in provided, .to -ether. ,.with the respective amounts due or each of said
tracts, pieces and parcels of land, which amounts shall include t1m
annual installments and the interest on the same on all unpaid balances
for one year at the rate of five (5) per cent per annum as aforesaid;
and such amounts soycertified-shall be collected as other taxes and
assessments are collected.
Sec. 9. This ordinance shall take effect and be in force from
and after its publication once in the Salina Evening Journal.
