1639 Improve Elm Street(Published in the Salina Evening Journal, November 2 ,1911.) OPDINANCE N0.1639. An Ordinance providing for the paving and excavating of Elm street, in the city of Salina, between the west line of Seventh street and the east line of Ninth street, specifying the manner of construction and providing for the cost thereof and the manner. of payment, and letting the contract therefor. Whereas, by resolution duly adopted on the 16th day of October, 1911, the mayor and council of the city of Salina,. Kansas, have de- clared that they deem it necessary to pave and excavate Elm street in said city between thb west line of Seventh street and the east line of Ninth street; and Whereas, said resolution was published -for ten (10) consecutive days in the "Salina. Evening Journal", a daily newspaper publishedin the city of Salina; and, Whereas., a majority of the residentowners of property liable to assessment and taxation for the cost of such paving., curbing, gutterigg and excavating of said street did not, within twenty (20) days from the last publication of such resolution, file with the city clerk of said city their protest against such improvements or the making thereof; therefore, Be it ordained by the Mayor and Councilmen -of the city of Salina: Section 1. That it .is necessary and herebjr ordered that Elm street in the city of Salina., Kansas, between the west line of NbiAertth street and the east line of Ninth street, be paved with asphaltic -concrete paving material, laid on a five (5) inch concrete base, forty-three (43) feet in width from gutter to gutter, except at the intersection of streets and alleys where such paving shall extend from lot line to lot line. `- "- -- Sec. 2. All excavating, filling and rolling necessary for the proper construction of said paving shall be done and such paving shall be laid according to the established grade of such Elm street as here- ;.tofore established by the ordinances of the city of Salina. Sec. 3. That the plans and specifications of the city engineer for the paving of such street, now on file with -the city clerk, are hereby adopted and approved as and for the plans and specifications for such. paving, and all the work herein and in such plans and specifications provided for shall be done in accordance therewith, which plans and specifications are hereby incorporated in and made a part of this ordi- nance; and all the work herein and therein provided for shall be done under the direction of the city engineer or his duly authorized aosistatt Sec. 4. That a contract be and is hereby let to the Kaw Paving Company, of Topeka, Kansas, for the paving and excavating of said Elm street, at and for the following price, viz: for asphaltic -concrete pavement, laid on a five (5) inch concrete base, as specified, one dollar and sixty five cents ($1.65) per square yard for the square yards of said asphaltic -concrete pavement actually laid on said street, and for all excavating on said spreet, as specified, thirty-three (33X) cents per cubic yard, which such prices are duly found to be fair and reason- able prices for such work and do not exceed the price of such work and improvement as shown by the estimate of the city engineer therefor made by him and now on file with the city clerk. Payment for such work shall be made on measurements made by the city engineer, and said city shall pay for such work in cash or in.improvement bonds as hereinafter pro- vided and described, at the option of the -mayor and. council. Sec. 5. After the passage of this ordinance, the mayor and council shall appoint three disinterestbd householders who after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation for the improvements herein provided for, shall, within ten (10) days after having been notified of their appoint- ment, proceed to appraise said lots and pices of ground liable to taxa- tion (without regard to any buildings or improvements thereon) and after making said, appraisement, shall return the same to the mayor and council at the first meeting thereof after such appraisement shall have been completed, and after such appraisement.is returned to the mayor and council the said mayor and council shall designate a time for holding a special session for the -purpose of hearing complaints and equalising said appraisement, of which special session due notice shallrbe given in the official city paper, and at said special session the mayor and council shall, if they deem it just and proper, alter or change such apprai seipeint. Sec. 6. For the purpose of paying for such paving, curbing and guttering and excavating, the mayor and council are hereby authorized and directed to issue bonds of the city of Salina, in an amount not to exceed the contract price and to run for such a period of time as the mayor and council shall determine, not exceeding however ten years from the date of such bonds and be payable in equal installments in each year for the life of said bonds, together with interest not to exceed five (5) per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas, and for the purpose of paying principal and interest on said bonds as they severally become due the mayor and council shall each year, during the life of said bonds, levy an assessment against the lots and pieces of ground liable to taxation for the improvements herein provid$d for in an amountsufficient to ppy the principal and interest for that year; Provided, that for the pur- pose of defraying the cost of paving and otherwise improving the squares and areas formed by the intersection of streets and alleys as well as where the improvement is through or adjacent to property of the city, for which the city would be liable, the assessments shall be made against all the taxable property def the city; and the city clerk shall certify said assessments, as they are severally made, to the county clerk of Saline county, at the same time and in the sane manner as other city taxes are certified, and said assessments shall be liable to the same penalties as all other taxes. Sec. 7. This ordinance shall take effect and be in force from and after its publication once in the Salina Evening Journal. Passed and approved November 20th, 1911. Attest: f ayor. City �Cerk. 0
