ORDINANCE N0.1638.
An Ordinance relating to and apportioning and levying special assess-
ments on certain lots and pieces of ground in the_ city__of Salina,
Kansas, to pay the cost of paving, curbing, guttering and excava-
ting Ninth street in said city, between the south wide of the main
line tracks of the Union Pacific Railroad where the same crosses
said Ninth street, and the north line of South street, and relating
to and providing for the collection and payment of such assessments.
Be it ordained by the Mayor and Councilmen of the city of Salina:
Section 1. That for the purpose'of paying the cost of paving,
curbing, guttering and excavating Ninth street in the city of Salina,
Kansas, between -the south bide of the main line tracks of the Union
Pacific Railroad where the same crosses said Ninth street, and the
north line of South street, there are hereby levied and assessed for
each block separately, as designated and defined in Sections two, three,
four, five, six, seven, eight and nine of this ordinance., on the pro-
perty liable therefor, being all the lots and pieces of ground lying
either side of said street to the center.of the block on either side
thereof, according.to the appraised value of said lots and pieces of
ground without regard to the buildings or improvements thereon, special
assessments covering the cost of such wore; and improvement; said special
assessments being based on the special valuati* and appraisement of
said lots and pieces of ground heretofore made by three disinterested
appraisers appointed by the mayor and council, which said appraisement
is hereby roferred to and made a part of this ordinance; and the
several amounts levied, apportioned and assessed against each of said
lodes and pieces of ground, according to the benefits as based upon such
appraisement and valuation to be derived by reason of the paving,
curbinglagutterinig and excavating of said Ninth street between the
limits hereinbefore defined, are described and designated as follows,
to -wit:
Sec. 2. For paving, curbing, guttering and excavating Ninth
street, between the south line of the main tracks of the Union Pacific
Railroad and the north line of Pine street and Bishop street on the
south:

Sec. 10. Said amounts levied apportioned and � �S6`y/
assessed as afore-
said shall be due and collectible in ten (10) equal annual installments,
the first becoming due in the year 1912, and one of said installments
falling due each year thereafter until all are
,. paid, and all to be
collected with interest as in this ordina#ce provided; Provided, that
the owner of any piece Of property liable for any such special assess-
ments may redeem his property from such liability by paying into the
city treasury the entire amount chargeable against the same as in this
ordinance specified at -any time within thirty (30) days after the pub-
lication of this ordinance and before the issuance of the bonds ofthe
city of Salina in paymAnt of the cost of said improvements, and his
property so paid on shall not thereafter be liable for the cost of said
improvements, nor any part of the said bonds.
Sec. 11. There is hereby further levied and assessed against
each lot and piece of ground described in sections two, three, four,
five, six, seven., eight and nine of this ordinance five (5) per cent
interest per annum on all of said installments therein mentioned, from
the date of the bonds to the time of the collection of each of said
installments, as provided by law, which shall be collected annually at
the same time and in the same manner as said installments, and after
the taking effect of this ordinance, and after the issuance of the
bonds as herein provided, it shall be the duty of the city clerk of
said city to annually, at the same time other city taxes are to be
certified and until all of said assessments so apportioned and levied
have been certified/to certify to the county clerk of Saline county,
Kansas, a full list of all property liable to taxation.0 and assessment
for such work and improvement, except such property on which the special
assessments aforesaid have been paid, as herein provided, together with
the respective amounts due on each of said tracts, pieces and parcels
of land, which amount shall include the annual installments and the
interest on the same on all unpaid balances, for one year at the rate
of-five (5) per cent per annum as aforesaid; and such amounts so cer-
tified shall be collected as other taxes and assessments are collmt4d.
Sec. 12. This ordinance shall take effect and be in force from
and after its publication once in the Salina Evening Journal.
