An ordinance provingdifor the paving of the alley between the sotth
side of Lot No. 15 on Seventh street and Loi No. 116 on Santa Fe
'r avenue(And Walnut street)and located between Santa Fe avenue and
Seventh street specifyi the manner of construction and providing
for the cost tAereof andhe manner of payment.
Whereas, a petition has been filed with the city clerk requesting
the mayor and council to pave and excavate the alley between the south
line of Lot No. 116 on Santa Fe amenue and Lot No. 115 on Seventh street
*F and Walnut street and lying between said Santa Fe avenue and Seventh
street; and,
Whereas, such petition has been examined by the mayor and council
and found to contain a majority of the names of the resident property
owners owning property abutting both sides of said alley between the
limits above defined; therefore,
Be it ordained by the Mayor and Councilmen of the city of Salina:
Section 1.' That it is necessary and hereby ordered that the alley
lying between Santa Fe avenue and Seventh street, in the city of Salina,
from the south line of Lot No. 115 on Seventh street and the south line
f -of Lot No. 116 on Santa Fe avenue(and Walnut street) be paved, with such
material as the mayor and counail may hereafter designate, the full
width thereof, viz: ten (10) feet.
Sec. 2. All excavating, rolling and filling necessary to properly
construct such paving shall be done, and such paving shall be constructed
according to the established grade of said alley as provided by the
oudinances of said city.
. Sec. 3. That the specifications for the paving of said alley and
the estimated cost of the same, made and prepared by the city engineer
and now on file with the city clerk, are hereby approved.
Sec. 4. After the passage of this ordinance the clerk shall ad-
vertise for bids for the construction of such paving, to be returned
on the 27th day of -'October, .1911, and after such - bids are received the
mayor and council shall determine the kind of paving to beused in said
alley, and are hereby authorized to let; -,the contract therefor.
Sec. 5. After the passage and publication of this ordinance the
mayor and council shall appoint three disinterested appraisers, who,
after having taken an oath to faithfully and impartial all lots and
pieces of ground liable to taxation for the improvement herein provided
for, shall, within ten days after having been notified of their appoint-
ment, proceed to appraise said lots and pieces of ground so.liable to
taxation (without regard to any buildings or improvements thereon) and
after making said appraisement, shall return the same to the mayor and
council at 'he first meeting thereof after such appraisement shall have
been made, and after such appraisemenet shall have been returned the said
mayor and council shall designate a time for kmrimg holding a special
session for the purpose of hearing complaints and equalizing said ap-
praisement, of which special session due notice shall be given in the
official city paper, and at said special session the mayor and council
shall, if they deem it just and proper, alter or change such appraisement
Sec. 6. For the purpose of paying for such improvement, the mayor
and council are hereby authorized and directed to to issue bonds of the
city of Salina, in an amount :i not to exceee contrast price of such
work and improvement, and to run for such a Iperiod of time as the mayor
and council shall determine, -not to exceed ten years from their date,
and made payable in equal installments in each year for the life of said
bonds, together with interest not to exceed five (5) per cent per annum,
and made payable at the fiscal agency of the State of Kansas, and for the
purpose of paying principal and the interest on said bonds as they sev-
erally become due the mayor and council shall each year during the life
of the bonds levy an assessment against the lots and pieces of ground
liable to taxation for the improvements herein provided for in an amount

sufficient to pay the principal and interest for that year;`and the city
clerk shall certify such assessments, as they are severally made, to
the county clerk of Saline county, Kansasl at the same time and in the
same manner as other city taxes are certified, and said assessments
shall be liable to the same penalties as all other taxes.
Sec. 7. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
