1632 Improve Elm Street�

ORDINANCE Nf.JYOZ-�✓,
An ordinance providing for the curbing and guttering of both sides of
-Elm street in the,'cit of Salina Kansas between the west line
of Seventh street and the east line of Niath street; specifying the
manner of construction, providing for the cost thereof and the
manner of paymentri and letting the contract therefor.
Whereas, Seventh street and Ninth street are parallel streets in
the city of Salina, and said Seventh street, including the square and
area formed by the crossing of Elgin and Seventh streets, has been paved,
curbed and guttered, and Ninth street, on both sides of said Elm street,
is now being paved, curbed and guttered; and,
'Whereas, said Elm street, between Seventh and Ninth streets, is an
intervening connecting street; and,
Whereas,
the
mayor and
council deem it
necessary and for the best
interests of
said
city that
said Elm street
between Seventh and
streets be curbed and guttered; therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina: --
Section 1. That it is necessary and hereby ordered that Elm street,
in the city of Salina, between the west line of Seventh street and the
east line of Ninth street be curbed on both sides thereof with cement
curbing, and guttered on both sides thereof with cement guttering, the
curb part of such improvement to be sig inches in.thi.ckness and the
gutter part thereof3 to be thirty inches, more or less, from the back
edge of such curb to the street, and the street line of.such curbing,
on moth sides of said street, shall be_feet from the center
line of said street, and at the intersections of said street with alleys
and with -Eighth street said curb and gutter shall recti M..,.to the lot line
on said Elm street.
Sec. 2. That all excavating, filling and rolling necessary for the
proper construction of such curbing and guttering shah be done.
Sec, 3. That the specifications of the city engineer now on file
with the city clerk for the curbing anuttering herein provided for
are hereby adopted and approved, and thw work herein and in such speci'"
fications provided for shall be done in all respects in accordance with
such specittations, which are hereby made a part of this ordinance, and
in obedience to the directions of the city engineer of said dity.
Sec. 4. That after the passage and publication of this ordinance
the mayor and council shall pmm appoint three disinterested househol.+
dere who after having taken an oat�to faithfully and impartially appraise
all lots and pieces of ground liable to taxation without regard to any
buildings or improvements thereon, and after making said appraisement
shall return the same to the city council at the first meeting thereof
after such appraisement shall have been completed, and after such ap-
prais ement is returned to the c Dunt it the mayor and council shall desig-
nate a time for holding a special session for the purpose of hearing com-
plaints and equalizing said appraisement, of which special session due
notice shall be given in the official city paper, and at said special
session the mayor and council shall, if they deem it just and proper,
alter or change such appraisement.
Sec. 5. That a contract be and is hereby let to W. H. Ringle and
C. H. Root, partners doing businessunder the firm name and style of
Ringle & Root, for the curbing and guttering provided for in this oro
dinance, at and for the uniform price of cents per
liheal f oot f or such curb and guttero
Sec. 6. For the purpose of paying for said curbing and guttering
in installments, instead of levying the entire tag or special assess-
ment for such cost at one time, the mayor and council are hereby au'-
thorised to issue improvement bonds of said city, payable in installments
of equal amounts each year, none of which bonds nor any of the install-
ments theredf shall run longer than ten years nor bear interest exceed-
ing five per cent per annum. Such bonds may be issued to the contractors
constructing such improvement in payment thereof, or the mayor and council
may sell said bonds at not less than their par value and pay the pro-
coeds thereof to the contractors in the amount owing such contractors,
and such bonds shall be of such denominations as the mayor and council
themay deem proper. And for the purpose of paying bizallash ixprincipal
and interest on said bonds, as they severally become due, the mayor and
council shall each year during the life of said bonds levy assessments
against the lots and pieces of ground liable to taxation for the im-
provement to an amount sufficient to pay the principal and interest for
that year; Provided, that for the purpose of paying the cost of curbing
and guttering the sgpxes and areas formed by the crossing of streets
and alleys, for which the city would be liable, the assessments shall be
made against all the taxable property of the city; and the city clerk
shall certify said assessments, as they are severally made, to the
county clerk of Saline county, Kansas, at the same time and in the same
manner as other city taxes are certified and to be collected as other
taxes are collected.
Sec. T. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
