ORDINANCE NO. J.JL
An ordinance amending sections seven, nine,, eleven, fourteen, fifteen,
sixteen and twenty-f9ur of Ordinance Wo.1510, being an ordinance
entitled "An Ordinance relating to the construction of buildings, and
the issuing of permits therefor, : and providing penalties for violations
hereof, and riapealing Ordinances Vos#563--&nd 588, and all ordinances
and parts of ordinances in clonflict herewith,"passed and approved
August 16,'1909; and repealing such prigin4sections so -amended.
Be it,ordainod by thr. Mayor and Councilmen of the City of Salina:
Section 1. That sections seven (7), nine (9). eleven (11),
fourteen (140. fifteen (15), sixteen"(16) and twenty-four (24) of
Ordinance No. 1510, passed and approved August 16, 1909, being an
ordinance entitled "an ordinance relating to the construction of
buildings,, and the issuing of permits therefor, and providing petal•
ties for violations hereof, and repealing oldinance Nos. 563 and 588,
and all ordinances and parts of ordinances in conflict hernwith" be
amended and changed as in this orditance provided
See. 2*' That section seven of Ordinance No.,1510-be amended
so as to rlsad as follows:
."See. "Proper foundations of mas.onvy shall be provided for
the support of buildings. No foundation for any stone, brick or
cerient building; e ted within the fire limits of the city shall be

Sec. 3. That seati its of Ordinance No.1510 be amended
so as to read as follows:

Provided.that partition walls of brick, stone or cement may
be built of a thickness four inches less than outside walls of the sane
a ryy and provided further, that yvith special permission of the fire
.chi first obtained, front and rear walls may be built of a thickness

used for orage, not more than one story in height, may be built with
walls not 1 than nine inches in thickness. Sheds of iron clad

provided, further,'tha on obtaining a permit therefor as provided in

Fee. 4. That section eleven of Ordin o.1510 be amended
so as to read ae follows;
"Sec. 11. All buildings hereafter erected with i the fire
limits shall have substantial Bide. fire walls extendin�;•.a east twenty
four inches in height, above where the roof connects with th 'walls,
this fire wall to be in thickness not less than twelve inches brick
or atone and not less than eight inches for cement block."
Sec. 5. That section fourteen of Ordinance No,,1510 be amended
so as to read as follows:
"Sec.14. Every building hereafter erected within the firo limits
in which the floor beams or rafter joists are to be supported by parti-
tion walls, they said partition walls, which shall in no case be lose
than nine inches, shall be composed of stone,'brick or cement: or in
place of walls there ray be brick, ' stone or cement piers or iron or
wood columns ... provided however, that inoses where, in the judgmment
of the fire chief, it becomes necessary to use wooden partitions in-
stead of stone, brick or cement as above,said prtitio•.s, which are to
support such floor beams or rafter joists, must in all cases be cover-
ed on both sides with metal lath to receive She plastering. And where
wooden partitions are erected in buildings already erected, they shall
be covered on both sides with plaster board and plastered; and where
buildings of two stories or more in height hereafter erected and within
the fire limits shall have scuttle openings, or bulkheads and door
built in the roof, the coverings,or doors shall be built of fire
proof material, self closing, equipped with fusible links, and shall
be provided with steps or ladder leading; from top story to the rood."

Sec. 7. That section sixteen of Ordinance No.1510 be amended
so as to read as follows:
"Bea. 16; All chimneys within the city of Salina shall be
built of brick, stone, or other fire proof material, subject to the
approval of the fire chief. All chimneys shall start from the found€ .
tion walls or from a solid brick or stone foundation, or shall be se-
curely built into stone or brick, wails of buildings.
The walls of all chimneys hereafter built shall be of a.
thickness of eight inches, provided however that chimney walls of four

work of any kind shall be built into any chimney or flue whatever.

Provided further, that bracket chimneys may be built only in
such buildings and under such restrictions as the fire chief may
permit and approve.

his opinion, they are dangerous or insecure; and when any such flue or
chimney is condemned it shall be torn down by the person erecting the
same and rgbAilt or be changed as the, fire chief may direct. Any per-
son violating any of the provisions of this section, whether he be the
owner, contractor, or person building said chimney or flue, shall on
conviction thereof be fined in any sum not more than, one hundred dollars
for each offense.*
Sec. 8. That section twenty-four of Ordinance No.1510 be
amended so as to read as follows:
. "Sea. 24. 'No wooden buildings or wooden additions to buildings
shall hereafter be constructed within the ftre limits of the -city, and
no portable structure or vehicle on wheels, used as a place of business,
or in which fuel of,any kind is used for cooking -or heating shAll be
located on any lot within such fire limits; and whenever any wooden
building or addition thereto, or any such portable structure afoiesaid
shall be constructed, erected; enlarged, moved into or removed wthin
such fire limits, contracy to the provisions of this ordinance, whether
the owner of any such buildingi, addition .9r_portable ' structure has a
permit for the erection thereof or -not 41,Vshall be the duty of the
fire chief, upon information that the 7 provisions of this ordinane are
being -or have been violated to issue an order to the owner, occupant,
person in charge or builder thereof demianding that rich building or
addition be taken down and removed, and upon refusal or neglect of such
person to comply with the requirements of such order, within forty-
eight hours after having received the same, the fire chief shall cause
said building or addition to be removed and taken down, and the expense
thereof may be recovered of the owner of such building or addition by
suit in any court of competent juiiediction. Any person violating
the provisions of this section, either as owner or contractor, shall,
in addition to the penalties hereinbefore provided, be deemed guilty
of a misdemeanor and upon conviction thereof be fined in any sum not
less than twenty-five nor more than one hundred dollars."

Sec. 10. Thit ordinanqe shall take effect and be in force
from and after its publication once in the Salina Rvening Journal.
