ORDINANCE NOAP
An Ordinance providing for the paving, curbing, guttering''and excavating
of College avenue in -the city of Salina, Kansas, between the south
line of Ash street and the south line of Walnut street, specifying
the manner of construction and providing for the cost thereof and
the manner of payment.
Whereas, a petition has been presented to the mayor and council,
requesting said mayor and council to pave, excavate, curb and gutter
College avenue in the city of Salina,i between the south line of Ash
street and the south line of Walnut street; and,
Whereas, such petition has been examined and found to contain a
majority of the names of the resident property owners owning property
abutting on both sides of said College avenue between the limits above
set forth, and that the mayor and council by virtue thereof have
jurisdiction to make the improvements in such petition prayed for,
therefore,
Be it'ordained by the Mayor and Council of the city of Salina: -
Section 1.' That it is necessary and hereby ordered that College
avenue in the city of Salina, Kansas,between the south line of Ash
stf(eet and the south line of Walnut street be peed, with such material
as the mayor and council may hereafter designate and select, as here -
ep ovided, said paving to be cr�
feet in width from gutter to gutter, except that at the intersections
of streets and alleys such pavement shall extend to the lot lines of
the intersecting streets.
Sec. 2. That it is necessary and hereby ordered that College
avenue between the limits defined in section one hereof, be curbed, on
both sides thereof; with cement curbing, and guttered, on both sides
thereof, with cement guttering, such curbing and guttering to be rude
and constructed in one piece as, a combined curb and gutter, the curb
part of the same to be six (6) inches in thickness and the gutter part
thereof to be thirty (30) inches, more or less, from the back edge of
such curb to the street, and such curbing shall be sett
feet from and parallel with the lot line on either side of said street,
etcept at the intersections of streets and alleys, where such curb and

gutter shall return to the,.lot line of said College avenue.
Sec. 3. All excavating, filling and rolling necessary for the
proper construction of said paving and curbing and guttering to be
done, and such paving and curbing and guttering shall be done and con-
structed -according to the established grade of said College avenue as
heretof ore established by the ordinances of the city of Salina..
Sec. 4. For the paving, curbing and guttering and work and im-
provement herein provided for, the city engineer shall make and file
with the city clerk on or before the next regular meeting of the city
council, plans and specifications thereof, which plans and specifica-
tions shall cover and embrace the different kinds of paving, such as
brick block with concrete foundation and asphaltic-concrete� and gement
curb and guttering, and said engineer shall also file an estimate
of the cost of the work and improvement herein provided for.
Sec. 5. That after such plans and specifications shall have
been filed with the sat city clerk, the mayor and

and council shall determine the kind of paving tobe used on said
street and may, and are hereby authorized to let the contract fob J,he

curbing and guttering and excavating of said street, tabhe
Sec. 6. After the passage of this ordinance, the mayor ad
council shall appoint three disinterested hous*holders who after
having taken an lath to faithfully and impartially gppraise all lots
aid pieces of ground liable to -taxation -for the improvements herein
provided for, shall, within ten (10) days after having been notified
of their appointment, proceed to appraise said lots and pieces cf
ground liable to taxation (without regard to any buildings or im-
provements thereon) and after making said appraisement, shall return
the same to the mayor and council at the first meeting thereof after
such appraisement shall have been completed, and after such appraise-
ment is returned to the mayor and council the said mayor and council
shall designate a time for holding a specigl session for the purpose
hearing complaints and equalizing said appraisement of which special
session due notice shall be given in the official city paper, and at
said special session the mayor and council shall, if they deem it
just and proper, alter or change such appraisement.
Sec. 7. For the purpose of paying for such paving, curbing
and guttering and excavating, the mayor and council are hereby author*
ized and directed to issue bonds of the city of Salina, in an amount
not to exceed the contract price and to run for such a'period of time
as the mayor and council shall determine., not -Fwd+ng
however —myears from the date of such bonds and be payable in
equal installments in each year for the life of said bonds, together
with interest not to exceed five t5) per cent per annum, which bonds
shall be made payable at the fiscal agency of the State of Kansas,
and for the purpose of paying principal and interest on said bonds as
they severally become due the mayor and council shall each year, during
the life of said bonds, levy an assessment against the lots and pieces
of ground liable to taxation for the improvements herein provided for
Sn an amount sufficient to pay the principal and interest for that
year; Provided, that for the purpose of defraying the cost of paving 4w
and otherwise improveing the squares and areas formed by the inter-
section of streets and alleys as well,: as where the improvement is
through or'adjacent to property of the city, for which the city would be
liable, the assessments shall be made against all the taxable.property
of the city; and the city clerk shall certify said assessments, as they
are severally -made, to the county clerk of Saline county, at the same
time and in the same manner as other city taxes re certified, and
said assessments shall be liable to the same penalties as All other
taxes.
Sec. 8. This ordinance shall take effect and be in force from
and after its publication once in the Salina Evening Journal.
