Be it ordained by the Mayor and Councilmen of the city of Salina:
Section 1. That for the purpose of paying the cost of paving,
curbing, guttering and excavating Prescott avenue, in the city of Sa-
lina, Kansas, between the west side of Fourth street and the east line
of Ninth street, there are hereby levied and assessed, fof each block
separately, on the property liable therefor, being all the lots and
pieces of ground lying on either side of said street to the center of
the block on either side thereof, according to the appraised value of
said lots and pieces of ground without regard to the buildings or im-
provements thereon, special assessments covering the cost of such work
and improvement; said special assessments being based on the special
valuation and appraisement of said lots and pieces of ground heretofore
made by three disinterested appraisers appointed by the mayor and coun-
cil, which said appraisement is hereby referred to and made a part of
this ordinance; and the several amounts levied, apportioned and assessed
against each of said lots and pieces of ground, according to the benefits
as based upon smchppraisement and valuation to be derived by reason of
uteri and excavating of said Prescott avenue,

avenue between the west line of Fourth street and the east line of
Santa Fe avenue:

Sec. 5. Said amounts levied, apportioned and assessed as aforesaid
shall be due and collectible in ten (10) equal 'annual installments, the
first becoming due in the year 1911, and one of said installments falling
due each Ayear thereafterz until all are paid, and all to be collected
with interest as in this ordinance provided; Provided, that the owner of
any piece of property liable for any.such special assessment may redeem
his property from such liability by paying into the city treasury the
entire amount chargeable against the same as in this ordinance speci-
fied at any time within thirty (40) days after the publication of this
ordinance and before the issuance of the bonds of the city of Salina in
payment of the cost of said improvements, end his property so paid on
shall not thereafter be liable for the cost of said improvements, nor
for any part of the said bonds.
Sec. 6. There is hereby further levied and assessed against.each
lot and piece of ground described in sections two, three and four of
this ordinance five (5) per cent interest per annum on all of said in-
stallments therein mentioned, from the date of the bonds to
the time of the collection of each of said installments, as provided by
law, which shall be collected annually at the same time and in the same
manner as said installments, and after the taking effect of this ordi-
nance, end after the issuance of the bonds as herein provided, it
shall be the duty of the city clerk of said city to annually, at the
same time other city taxes are to be certified and until all of said
assessments so apportioned and levied have been certified to certify to
the county clerk of Saline county, Kansas, a full list of all property
liable to taxation and assessment for such work and improvement, except
such property on which the special assessments aforesaid have been paid,,
as herein provided, together with the respective amounts due on each of
said tracts, pieces and parcels of land, which amounts shall include the
annual installments and the interest on the same on all unpaid balances
for. one year at the rate of five (5) per cent per annum as aforesaid; and
such amounts so cer+,ified shall be collected as other taxes and assess-
ments are collected.
Sec. 7. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
